Need abit of help if i can please.
I wrote to the bank asking for my money back totaling £3030.00. I had the standard letter - we'll get back to you in a few weeks.
After reading the posts on here, i then decided to send the next letter - "not had a saisfactory responce from you - so i'm going to proceed through the county court" I also added the bit about "Wihtout Preducice" saying if they offer me £2775.00 (which is 75% of the amount plus interest - £3702.52) then i would accept.
In the mean time i received a letter making an offer came for £2270.00 (which is 75% excluding the interest)- crossing in the post.
I called Barclays up to say i was not happy with this and they have told me to put this in writing. As ive already sent the letter saying what im prepared to accept is it worth sending another? Is there a standard one on here?

The 8% interest is only payable if you actually get to the court stage so it won't be included in any offer made before you actually file to take them to court. This means that any offer you say you will accept should not include the interest.0

I am currently trying to reclaim my charges i have sent off LBA 14 days ago now but my boyfriend has just told me he forgot to send it recorded when i asked for the recipt to see if it had been recieved. Where do i stand now ?? can i carry on and go for legal action or send another LBA recorded?
any advice would be really welcome

It says
Upon the Courts own motion. The COurt has made this order of its own initiative without a hearing etc
It is ordered that
Directions will be given in this case by the disignated Civil Judge etc
The heading says General Form of Judgement or Order0 -
Cool - thanks for that Molly - so he doesnt actually have a hearing to attend then.
All thats happened from what you have written is the case has been passed to the Civil Judge who will pass directions and you'll get a further General Form of Judgement or Order with those directions on it.
Are you sure thats all it says ?
Directions are basically what you should provide to the court, and the other party, and when, and what the defendants should provide to the court, and you, and whenLegalBeagles0 -

I thought it reads as if the courts are starting to get a bit peeved with the banks no shows and were trying to speed things up??? As it said about the court using initiative?? The County courts must be getting SO fed up with all the no-shows particulalry with all the extra publicity and more people claiming.0 -
Oh yes the court are very very hacked off with the whole affair. but hands are tied etc.
Ok. Does it say he can make representations in writing ?
Basically he can ask for directions to be ordered. I'll get a draft directions order which works a treat if the judge goes for it if you like.
The bank probably wont bother turning up, and may even settle before, but if he can go, and wants to, then go armed with directions you want the judge to imposeLegalBeagles0 -
Hi people,
I have just started my battle with barclays a few weeks ago, I have had a first offer of just over £500 but i have all my statments apart form 1 years worth.
With the statments i have it totals in excess of £600 and with intrest i could get nearly £900.
I have been intouch and asked for them to send out the whole six years worth and nearly 3 weeks later they have not arrived.
Thanks esmerellda for that info i have set it to record, should be intresting.0
