Yep its completely normal....you'll get an acknowlegdment of service within a couple of weeks, and then a defence probably a couple weeks later..... from there you file your allocation questionnaire (will cost you £100 but you get it back when you win) then its down to the judge at your court to send out some directions (instructions on what info to provide) and then a court date.
Barclays probably will take you past allocation questionnaire stage but not right up to a hearing date....

I wouldn't worry about it too much as most people dont seem to know that you cant claim the interest untill you have started court action anyway. Why not phone them and tell them about the interest and unless they make a better offer or you will go to court and claim the interest

Actually you can claim the interest before court...i did this with my cc a few weeks ago and got every penny back after one letter and a couple of phone calls and thats with the OFT ruling...however i realise every bank acts differently (this was HFC) but i still think its is a good thing, as when it goes to court it looks good to the judge that you've done everything you can to resolve the issue before its ended up in court, including reducing the amount your willing to settle for...I done the same with my second letter to barclays (LBA) saying i'd settle for the full amount minus the interest as a 'gesture of good will' and got offered £1000 out of a claim for £4400...now filed my claim online...Personally i'd hold out for the full amount but if you think the offer looks good..run with it

your right you can claim it; but what i was trying to say was that the banks dont have to pay it by law unless you get to court action stage.Not just a white vanman:cool:

Hi all, I sent the Prelim letter 0n 7th March 07. Received no letter from barclays.
Then on checking my account online on 19th March 07, found they had credited the whole lot!
£420! exactly what I asked for. Maybe they didnt want the hassle for a small claim so paid up!

I dont know what Barclays are playing at now.....I went online yesterday and it said I couldn't ask for a judgement to be made as 14 days hadn't passed. I went on today at 3.30pm and I was able to ask for judgement as Barclays hadn't responded. So i'm just waiting to see if there is a back log in placing the info on the system as they haven't asked for extra time or said they were going to contest. I'll keep checking the system every day until Friday to see what will happen next......total cost £2100 from 2 bank accounts....fingers crossed:o

I have all my statements and am about to try and claim my charges back including the interest, this claim is of an amount which is not equal to the total amount of my overdraft. I am a bit reluctant to make any claim at present.
I have already set up a parachute account which has a small overdraft facitlity - not enough to cover the one which is with my account at Barclays.
I am currently in the process of buying a house with my partner - not through Barclays but don't want this to affect any application which I am about to make i.e. my credit score.
A few questions I would like to be answered before i make any claim are:-
1. Would it be better to wait until my mortgage was in place before claiming??
2. Are the timescales given i.e. the 14 days from LBA working days??
and
3. Has anyone who has claimed from Barclays had their account closed and forced to pay back their overdraft; if so have they asked for the amount in full or did you agree to pay over a period of time??
Anyone who can help with these queries would be greatly appreciated.0 -
At long last i have now received my court date; 16 April.
It has been allocated to the small claims track. and i have to send a load of stuff in(court bundle i would asume) but not sure about this:
'A statement of evidence, if such is to be relied upon as tending to show that the alleged charges have been made, or that they are irrecoverable as penalties.'
And in the court bundle the link to the OFT report is no longer active. what do i do about that.? any ideas?Not just a white vanman:cool:

Sorry m8..I see your point now and totally agree...If they offer you the full amount without interest before you go to court you should always take it or you'll just look like your being greedy to the judge who might reduce the amount or make you pay the court costs.....
