  • hi im a tad confused !!! have been trying to pursue barclays for weeks for £1056 got usual letters an offer of 380, then raised to 500, said no way ,then a letter saying your not getting anything else from us ,basicly said take us to court . Filed a MCOL on monday for total now of 1200 ish. Today got a letter today saying " we understand you are not happy with some charges applied to your account, to investigate we are requesting that a copy of all statements be sent to you so you can see details of all charges applied to your account" etc etc . Phoned bank on number given in letter and explained i had been all through this process already and were at the stage of court action, the bloke on the phone had no knowledge of any of the correspondance that has been going on over the last few weeks, letter today was from retail banking customer relations, leicester and previous correspondance from retail banking customer relations, wales ????

    Im so confused !!!! the bloke today was very friendly though, no attitude as ive had previously, he told me to copy all my correspondance and send it to the leicester address and he'd get it looked at.

    What do i do, send the info and hope it makes them make a better offer. or leave them to do their own work work or (im getting a bit paranoid now) is this a trick ?????

    Send off the info requested but make sure you tell the bank that now you have filed at court you wish the whole claim settled, plus the interest and the court fees.

    Phoned Barclays to tell them again I would be happy with 840 pounds still without interest.
    The guy told me that he would not pay up and that he would make a note of my call?
    How stupid is that? Barclays could have saved themselves court costs and interest on the final day before i file judgement, but still refused?

    Is this normal?

  • I was due to send the third letter to Barclays informing them that I would be proceeding with taking the matter to court but I received a letter from them first telling me that they will sort the matter by 20th April. Should I just hold out until then? Thing is if they're just going to offer me partial refunds it's just going to drag on and on....
  • I had already sent this to the discussion area but no replys so will try here.
    As expected i received the defence from Barclays yesterday(21st) They put their defence in on the 15th.
    No1. Says i do not provide details or particulars of the precise charges alleged to have been unlawful. Well this is rubbish as they have been sent all this in great detail twice.
    No2. They go on to say the defence is summary in nature and the defendant reserves the right to amend this statement in due course. I imagine that is put in there to cover theirselves for when they decide to settle?
    3ab&c. Is a load of waffle about how they have the right to charge "paid referral fees"and administrative fees etc, plus the right to charge if the claimant becomes overdrawn without an overdraft limit.
    4. This says all their charges are laid out clearly and give the claimant a transparent view of all the terms and conditions.
    9.They say the charges and interest are and remain lawful and enforceble and that they were entitled to debit the same.
    10. This says there are a few dates prior to 15th Feb 01 that are not recoverable because they are time barred under the terms and limitations act 1980.(fair enough i guess)
    11. Finally they say they have suffered loss and damage as a consequence of such breach of contract because i allowed my account to go into unauthorised overdarft. Then they waffle something about recovering charges from me not necessarily to be limited to the value of the said charge!!(dont quite know how they work that out)
    Hope someone can take the time to read this hot air and let me know if this is all standard stuff to try and frighten me away.

  • I have requested the statements a couple of weeks ago. Does anyone know a phone number to follow them up to see if they have sent out my statements. I assume this is the right approach that this stage. Many thanks.

    morning all ive received a letter from barclays this morning again a letter full of jargon cut to the chase they have offered me £500 in full and final settlement of the matter " i originally claimied £800 " this is great news - wanted some advice " do you think I should except this and close the matter - I really am over the moon about this - cannot thank you all enough on this site, now im helping every1 in the office claim there charges back -

    If that was my offer then i'd refuse it, it rather depends on your circumstances if you badly need the cash then accept. But i'd go ahead and claim the full amount with your 2nd letter.

    If your happy with the amount they have offered then great but, I'm quite sure if you push a little harder you'll get it all back. It's up to you though.
