Hi Everyone
I've been a bit of a bystander here seeing what everyone else has gone through but have proceeded with claims of my own.
We put a claim in with Barclays for £595, got to the point where we had to claim through the courts. I lodged the claim on Tuesday, and today we've got a letter offering us £445 as a gesture of goodwill!
I think I'm going to phone them up and see if I can get them up to £550 and I'll forget the £80 court fee.
What does everyone else think?0 -
Our court date is next Monday, got home yesterday to find Barclays had phoned.
Hubby phoned today and we have a full settlement £1252 - wooooooo
I'll wait until we get the cheque by registered post ( said SAt) in my little hands!!!!
As a time scale for those still trying we filed on line on New Year's Eve so just under 3 months and we had no offers at all from Barclays in that time.
After watching Whistleblower last night watch out Barclays.
Anyone still thinking about it - go for it!!!!0 -
got a letter from barclays today, saying they wont pay my claim(1099) as their charges only amount to 735, thought i had messed up to calculated again and i still make it 1099, what are they playing at ????0

theres a link on this site, its for starting to claim back the money from your bank account, ive signed up recietly,
if they are telling you that the matter will be resolved in april its probly a delay tactic, you could always send them the next letter or start the court procedings, depending how far you've already got.
Im only sent my first letter asking for my statements and they sent me a letter offering a settlement, this only came a day after i recived my statments.
thing is though today ive sent my first letter advicing them how much including interest, and that i would be willing to settle for just the bank charges. will have to wait for their responce, but hopefully my plan will work n ill get the charges back (£3450)0 -

MCOL is money claim on line, basicly a court on line (i think). but i didnt use this as i used my local copunty court because if you are on low income or tax credits like i am then you can fill in an EX160 form that excudes you from court fees.:T
As for waiting for the 20th for your bank to get back to you they are stalling tactics. They wouldnt give you extra time to get back to them if you owed them a couple of grand would they,so why the hell should you wait for them. So get that next letter to them the day after your deadline runs out my friend.

Make sure you've only added the charges...should be even figure at the end as charges are always even figures (ie.£20, £25, £30, £35) so your figure is wrong unless thats with 8% interest added?
You can only claim for :
Paid Referral Fee
Fee £30 per account per day (maximum charge of £90) per account within each monthly charging period).
A Paid Referral Fee of £30 is charged when we pay an item that results in your account going overdrawn by more than £5* without an agreed limit, or by more than £5* above an agreed limit. In addition, this fee will also be charged if we pay any further items that increase your unauthorised borrowing by £1 or more.
If you stay within your agreed overdraft limit for a period of 12 months we will automatically refund the first Paid Referral Fee incurred. If, however, your account does become further overdrawn you will incur paid referral fees in line with the above.
* £25 for Platinum Banking customers.
Unpaid fee
£35 (maximum per account per day).
If you go overdrawn without agreement or if you exceed your agreed limit, we may return your cheques, standing orders or Direct Debits.
You can't claim for the interest at the end of your statements...I have a overdraft i live in for £650 and get charged about £4-5 a month interest...i can not claim that back...nor can i claim for the payment protection (650 @ £0.80).0 -
hi thanks for reply, yes this is with added interest, all the fees are 25,30 and 35, total £1055+£44.56 interest = £1099.56
Fees are paid referral,unpaids out,and one for commission(charge).
After watching whistleblower dont trust them at all.0 -
The commission charge might be/come under one of their services in which case you can't claim it...some of them aren't outside the 6yr limit are they?
If there not i'd send in a copy of the statements with charges, and highlight them, while reminding them how much time they have left against the time limit you've set...oh and send it recorded delivery so you will have some proof it was sent, just incase they argue in court that they didn't have all the info in a reasonable time..or maybe you could fax it to them? ring them and get their fax number??0 -
Hi I have succeeded in getting an offer on my claim but I think I will go for the full amount. barclays have offered me £705.00 'as a goodwill gesture' against my claim for £1061.00 can anyone give me a format for this letter?0
