Hi all,
Im about to file a court claim asking for ALL my money back. Which address should I put for useless, im mean Barclays bank as they have so many??
I have put in for a claim for £1500. Offered me £650. Have sent my second letter threating to take them to court but no reply. Time to bite the bullet and go for it!!

I put the address of my local branch and it worked for me, after all it was there that i walked into to open my account.

Barclays have entered a defence so I have to fill in the Allocation Questionnaire. Part of their defence is that some of the charges claimed are beyond six years. They were all within 6 years when I first wrote to Barclays but by the time I took it to court a couple of months of them ignoring me had passed.
Here's my question(s)
1) Should I reduce my claim to only the charges that fall within teh six years OR .....
2) Should I leave the claim as it is but offer to reduce it by the ammount beyond 6 years OR ...
3) Should I just leave it as it is0 -
Just got the defence for my claim on the last day and they have used similiar in my defence stating charges before 2001 out of date but started procedure beg of december 2006, i don't know what to do either. Not started filling allocation questionnare in yet, fed up as both friends i have helped bank with Halifax and they have paid out. Moral to the tale stuff Barclays.0

I suppose the answer to that is it is now in the hands of the judge - fill in the allocation questionnaire (see Consumer Action Group Website for the procedure, and what to put on the form), send that in (with the £100 if the amount you are claiming is over £1500). Make sure you mention the bit about Standard Disclosure - with Standard Disclosure the judge orders the bank to disclose the break-down of their charges - I am assuming that this would have to be supplied with the Bank's Court Bundle, which you get a copy of... you are told to send in a Court bundle too - one to the Defendant (Barclays) and on to the Court, keeping one for yourself. All the details and Downloadable Court bundle on CAG site. I would suspect that at this stage the bank will want to make a serious offer, as I cannot imagine the Bank sending you a Standard Disclosure with Their bundle......

My philosophy with the whole shebang is stick it out - they have had your money for years, and its about time they gave it all back. If they close my account it will save me the hassle of doing it myself.... which I plan to do just as soon as they pay up.
I stuck with the process with a claim against the Bank of Scotland, and when they ignored everything I got summary judgement and issued a warrant the next day... bailiffs go in before the 23rd :beer: plan to pay off a term loan and close the account ASAP. I should still be about £500 quid up.

In my case too it was the very last day. Made even more annoying by the fact that the ACTUAL last day (which by an acknowledgement they had extended to 28 days) fell on a Saturday. However I could not seek judgement as they had until 4 pm on the next working day (Monday) which they, of course knew and waited until then to file a defence. If this is a common factor with others and also common that they ignore people and let some charges slip beyond the 6 years only to later claim this as a defence they should be vilified or perhaps even prosecuted for using the tactics of a common crook and wasting the courts and other peoples time.0 -
Hi people,
I have my court date and am basically just waiting now...
I wondered if anybody in the past - involving Barclays - has either got in touch with them and managed to get their money without waiting it out, or that Barclays have been in touch before the very bitter end!? (ie, just before the court date)
I'm trying to get an idea of if I'll have to wait until the day before my court date or something.... if anybody has any experience with this, please reply and let me know!0 -
We also have a court date - March 26th.
Not had any offers so will have to wait and see!!
Do we have to send the bundle to Barclays and court before that date? Have to do some more research for this step I think.
Already done questionnaire
Would be nice if we had the refund on that day as it is also my birthday!!!!0
