nadeembutt wrote:Could someone please help me? I sent barclays a Data Protection Act 1998
Subject Access Request with a £10 cheque.
Just recieved a letter from them basically saying that
"please be aware that the bank is not under an obligation to present information according to any particular format. Therefore your request to assemble a schedule of charges is turned aside.
They go on to say we'll give you a copy of your bank statemetns for free but
"Some statement information from the period prior to and possible during 1999 to 2000 is manually stored in the form of microfiche and does not fall within the data subject access provisions of the DPA"
"also states the DPA does not oblige the bank to comment about internal policies and procedures"
"Whilst aggregated information is retained for statistical purposes, this would not constitute "personal data" under the DPA and therefore would not be covered by a s.7 DPA subject access request"
Someone please help me and tell me what on earth they are saying in laymans terms and what my next step should be?
Should i wait for my statements and then calculate and send the schedule of charges and second letter requesting they pay my the monies owed??
I've had this letter aswell and my 40 days are nearly up so need some help on where to go next please!! (Baby due in 10 days so want to try and get sorted before sleepless nights etc!)
Thanks.Wins this year : Product of the year goodie bag, bath in fashion experience :j0 -
Hi everyone !
This is my 1st post... hope it works!
I am just about to start what appears to be quite a daunting process, but after reading all the success stories I feel reasonably confident. I have downloaded and looked at all the sample letters and hopefully will start soon.
I have two questions before i start........
1) I see the first step is to open a parachute account, now I dont have a great credit history, I have looked at several banks websites and they all say that a credit check will be carried out before a decision is made. I have applied for loans and finance recently and all have been refused when a credit check is done, so naturally i am concerned about this when opening a new account. Can anyone recommend a good bank account for someone with a dodgy credit history that has the facalities for direct debits with a debit card?
2) When i start the process I will be claiming from Barclays. Now, do I write the initial letter requesting statements to the PO Box address on my statements, or address the letter to the manager at my own branch, and who do i make the cheque payable to!!!!!!0 -
Just sent MCOL to Barclays also for £1095, they seem to be a hard bank to crack.
Letter saying it would take 8 weeks due to backlog.
I Phoned Barclays to say I will accept payment without interest, but was refused.
So now claiming for the lot.0 -
Bank: Halifax
Amount charged: £775
Amount refunded: £750
Time : 2 weeks
Just had a call from Halifax customer service offering full refund (I did not claim interest) except for the first £25 charge I listed which was out of date. They will refund to my account within 14 days. This is after just one letter. I can't tell you how pleased I am. I never expected it to be settled so quickly and easily.
I can only add my encouragement to that already posted here. If you're owed these charges, then claim them.
Thanks, Martin, for highlighting this issue and helping all of us get what we're owed :T0 -
Dan... Welcome
1 - Cant offer any advice about Parachute account, as i went ahead with claim against barclays without doign so. But like you i have recenlty applied for credit and been refused. But does not appear to be any reports about closure of accounts.
2 - Call them and ask for statements, i did this, they took £5 out of my account for the service but they turned up in about a week.
I have sent all my correspondence to The Liecester Service Centre address. Recordered Delivery. had a written response withing 5 days.0 -

Check the Budgeting and Current Account Board for a new account and read the Reclaim Help Thread, link in my signature, post 1 for the address to use.0 -
Hello,
I sent barclays a letter (my first letter to them) 13 days ago asking for £1705 threatening to take them to court in 14 days time should I not recieve the money.
They have sent me a letter today, a standard we are sorry you are not happy with our service letter, saying they will deal with my complaint soon, but not later than 23rd March.
My date I told them in the first letter is tomorrow of taking it to the small claims court, shall I wait for them to contact me ? Ring them ? Send them another letter informing them im taking it to court if I dont get the full amount, or shall I just file a claim with the small claims court tomorrow ?
Thanks for your time.0 -

You must send them the letter before action giving them 7 days before filing a court action.0 -
Hi
I sent my first letter to barclays on 15th february and received the same letter as you saying they would deal witht he complaint by 16th march, I decided not to wait for them and stick to my time scale and sent them the next letter telling them I was taking it to small claims on 5th March so I gave them an extra 5 days, have today received a letter saying that their charges are justified but as a gesture of goodwill they will make a part payment. Not sure what Im going to do now though!!!
Stick to you own time scale, they would if it was the other way round.
Good luck0
