Filed my claim on MCOL today...£4400 plus interest...Maybe the best £120 i've ever spent...or maybe that'll be for the AQ, that is soon to be winging its way towards my letterbox...btw thanks HFC for giving me £200 last week and making this so much easier for me to afford to sue barclays...Would have had to put it off for a least a month otherwise...

I have no proof of this, but I have a feeling that Barclays may be asking claimants to agree to a non-disclosure / confidentiality clause. They seem a rather large banking group to be not getting their pro-rata claims. I think if there were a large number of claimants losing against Barclays, we would hear about it.

Maybe their master plan is that if there are no big success stories in the media, potential new claimants may have second thoughts.

    I could be wrong...

Hi - the usual advice is stick to YOUR timetable...most of the banks have tried this and its seen by claimants as a ploy to try and get us to stall.:-)

I will post my experience so far for people to compare

Initial letter requestiong £2600 refund on the 20th feb.

Recived a response dated 26th Feb saying that they will investigate and return to me asap , but no later than 19 march.

I thought this was a lot of time to investigate considering after recieving 6 years statments it only took me 1 hour to calculate the sum.

So i have sent by recorded delivery today a letter thanking them for a prompt response and offering them a chance to settle my claim now for £2300 by 9th march. If they fail to meet this timescale and offer i will proceed to court action and recover the full amount.

I have worked in a legal department before, and it is always good to make an early offer of settlement. if it goes to court a judge will not look favourably on the party who refused an early offer of settlement that could have been avoided and saved the courts time.

    see what they say....

I have been corresponding with the Leicester address.

I have tried to resolve the matter on the phone but they dont entertain this at all, not even if you clearly state they could save money by settleing now.

hope this helps anyone with a barclays claim. Please PM if you are in a simular situation so we can compare progress......

    Hi Larks01

I would be really interested in hearing how you got on with your letter, as I too recieved a letter only this morning stating that they "are looking into my concerns & will let me have an answer by 21st March 07 at the latest".

Like you I feel that this is a delay tactic (it was rec'd on the last of the 14 days timeframe) & would like to proceed to the next step, however it your outcome is good, I was thinking of going down this road first before doing the i am going to court take you to court letter.

Please can you keep us posted & any further advice?

Did the court not award that the bank pays your court costs?
  • I wrote to Barclays on 26th Feb giving them the 14 days to repay all the charges they had placed on my account, This morning (8th March) I received a letter from them saying."We are sorry that you have had to contact us about the level of service you have received from Barclays, and Thank you for taking the time to contact us. We are looking into your concerns and will let you have the answer or update as quickly as possible but no later than the 23rd of march" In the meantime if you wish to discuss this matter further please call us and they have included a leaflet of how Barclays deal with complaints.
What I want to know is do I now give them this extra time to deal with my claim or do I go to the second stage of issuing them with court proceedings? I would be grateful for any help you could give me in this matter.
    Best Wishes

Ok a couple of questions guyz please help

1-I have all of my statements so i've photocopied them and highlighted the charges is that ok?
2- my claim is for £1610 plus interest have i got anything to lose?
3- i'm using a £1500 overdraft facility constantly ( mostly due to these charges racking up over past 6 years) what are the chances f them closing my account ?

    and

4- now there's this OFT ruling??? should i bother or do i have no chance, i'm a really busy person(arent we all) and don't want to waste my time if its pointless.

    Many thanks in advance

1 - Yeah that sounds fine. always keep a copt.
2 - You are only entitled to claim interest at the point court proceedings are commenced. although its been known for people to claim interest and have it paid. you can only make this call. i would suggest initially not to claim interest, but perhaps just the threat that you will do if they dont settle before court proceedings.

3 - i have a 1700 OD with barclays and my claim is still in the early stages. i am really hoping they dont close my account or OD. not heard of this. They wont really have justified reason to do so.

4 again a judgment call only you can make. are you to busy for 1600 ? nothing ventured. nothing gained.

    hope this helps.
