    You should follow your timetable unless they have stated that is their final offer. Otherwise, when their 14 days from your LBA is up, start the court claim.

    The LBA is letter before action. i.e you've asked politely that they reimburse you, they've refused/ignored your request, so you send a letter requesting it again and informing them that you will take further action to recover your money.

    If you follow the links in the 'reclaim...' bar along the top of this forum, every step is explained. The 'timetable' is how you progress your claim: subject access request (if needed), polite request, letter beofre action etc.

    YOU set the timetable by, say, giving the bank 14 days to respond to a letter. If they don't, well, they've had their chance.

    Until a few weeks ago Barclays used to make fairly derisory offers early on and the offers seemed to ceiling at £1000 regardless of amount claimed. There have recently started to offer slightly more but generally nothing worth settling for!

    Whether or not to include interest is a matter of choice and seems to have little bearing on the offer made. Some people say that banks are more likely to settle if you make clear that you WILL add interest if you have to progress your claim. Barclays is not one of these banks.

    If the bank settles at the last minute, then YES include all charges, 8% interest etc. You are totally calling the shots by this point. They will pay it all to avoid the courtroom and I have never known Barclays end up in the courtroom because the weren't willing to pay the fees/interest. After all, if they do end up in court, they have to give you all of this AND disclose sensitive business information, which will cost them far more... millions of times more.

    Hi Guys,

    I'd really appreciate it if someone could help me. My husband and I are have both started asking for our charges back from NatWest and Barclays. My husband is asking for about 2800 to be refunded, and today he received a letter from Barclays offering him 1000. Obviously we aren't going to accept it, but how do we do it? I think we should send a letter by recorded delivery, as then we have a record of it, but what should we say? Is there a template letter kicking about?

    What letter did you get this offer after? Was it the first request letter?

    If it was the first request letter. Write back using the template Martin has provided in step 4 of reclaiming (this one threatens court action if the claim isn't settled).

    Add these words to the template as your first paragraph....................

    I’m afraid I cannot accept your offer of £1000 as full and final settlement of my claim. I would accept this amount as a part payment and without prejudice, but I will continue the claim for the balance.

    ................Then fill in the rest of the template as you need.

  • hi there have just received letter from barclays saying accept the offer of 360 instead of 947 that they owe or take me to court. So am thinking of court part but crapping myself if i lose am i going to be liable for court costs ???

    Or shall i just do it
  • I have read in the guide that it takes 5 days for the cliam to be serviced is that working days or just days ? If the bank does nothing in 14 days i win by default is that 14 days from my 5

    The claim is normally served within 5 days.

    After it is served, the count starts for their response.

    To answer your other question about costs, in the small claims, you are not normally liable for any, even if you lose.
