  • At the court stage you can claim the interest and court costs so with this letter before action leave in the interest part of the letter.

    At the small claims court stage. Completing the 'Allocation questionnaire' and I'm asked 'Do you wish any further action in this claim to be postponed for one month so that you and the other party can attempt to settle the claim either by informal discussion or by alternative dispute resolution?'. By ticking 'No' do I then prevent them from settling out of court? Don't want to hinder settlement. Can anyone advise?

    This won't affect any out of court settlement offer.

    Hi All

    Just phoned Barclays they say they haven't received my 2nd letter even though I have checked and the letter has been signed for. They won't budge on their first offer they made of £600 (claiming back £1255 plus interest). They said if letter mentions going to court they will just let us take that action.
    So here goes on-line claim to beginning any advice would be gratefully accepted.

  • Not sure if i'm in the right place, but i wrote to Barclays at the begining of Feb 2007 reclaiming bank charges on 2 accounts. I have not received any statements for either account but i have been offered a settlement figure for 1 account only. Do i take it or carryon fighting, and this is only after the 1st template letter:o

    You should try hold off whether to accept their offer until the statements arrive if you can. If you can, add up all the charges and see how close their offer is.

  • The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly.

    This is what it says on moneyclaim.... what do i do?
  • I'm assuming from what you have said that you have claimed via MoneyClaim online and now the bank has put in a defence. You wait now until you hear from MoneyClaim that your case will be transferred to your local court and you will be sent an Allocation Questionnaire to fill it.     Sorry if I'm posting in the wrong place but I've just been reading through this thread to find information on claiming back charges from Barclays but am left with a few questions before I begin:

    1 I have three accounts with Barclays can I make one claim for charges on them all?

    2 One of my accounts is a business account. Can I claim back charges in the same manner as a personal account?

    3 Do I need to make seperate requests for data relating to previous charges on each account?

    4 Do I need to pay £10 for each account's information?

    5 I have seen a post stating that Barclays will supply statements dating back 12 years. Can you claim charges back that far?

    Thanks for all the help so far and in advance for help with these questions.
