Steve_T wrote:I'm claiming £3332 from Barclays (inc interest) Today I have a letter from them dated 11th Feb saying my claim is tosh but they'll offer me £1000. I believe it is teh County Court action they are refering to and this is what has pushed them into action.
If this offer is not acceptable, you could let them know, they've had time to respond with a full settlement and have failed to do so. Now the matter is in the court process and they must pay court costs and interest to prevent the claim continuing.0 -
Sent my first letter to barclays yesterday for my sole account claiming £1158 back (for last 6 years) and they recieved it today...sent it recorded delivery to stop them denying they've recieved it and holding the process up....and now i have just sent my joint account letter off today claiming back £4010! I'm buzzing thinking of the money, (even though its gonna take months to get it back if they stick to their usual line of 'our terms and conditions state blah blah blah')......
Expecting them to ignore me, then offer me half of the amount claimed, which i'll reject, then i'm gonna ring them before i hit the send button at moneyclaim and offer them 1 last chance to give me either a decent amount of my claim back or i'm taking them to court and then i'll want all the charges plus interest plus court costs.....think i'll mention in my next letter that i'm willing, as a gesture of good will, to take just the charges back and scrap the interest (£193 on sole account and £575 on joint) just to get it finished with......
I'll keep you all updated....0 -
Hi everyone,
Need some tips for the court bundle.
I've downloaded the pack from the Consumer Action Group, and that's great - is that all generic? ie, there isn't anything in there which I need to amend to my own details?
I'm also going to include a list of my charges and their dates, along with the OFT report and early day motion.
Do you think there's anything else I might need? Want to get it finished within the next couple of days...
Any tips would be welcome, thank you :A0 -

What's this OFT report and early day motion? Where do I get them from?
Thanks0 -

Try having a look at this page (right at the bottom, 'Which? factsheet: the small claims court (PDF: 56Kb)'.
http://www.which.co.uk/reports_and_campaigns/money/campaigns/Banking%20and%20credit/Bank%20charges/credit_card_charges_559_76920.jsp
I know it say's 'Credit Cards' at the top but i found it first while looking for bank charges court advice.
Hope that helps...pls let me know how you get on and what you put in your claims form cause i'm going for money from barclays so i know i'm going to court even though i only sent my 1st letter 2 days ago0 -
Now Barclays have filed an "ackowledgement of service" form which gives them 28 days to file a defence instead of 14. In another letter they've offered £1000 agaisnt the £3300 claim (inc interest) which I'm inclined not to accept. My copy of the form they've filed is signed by their solicitor of the "Litigation and Disputes" dept. I see a pattern emerging which is probably the tactics they've developed for this situation 1) Ignore all customers letters 2) respond only if/when it goes to court 3) use the simplest way to extend the period (acknowledge the service)
Perhaps this is all in an effort to wear me down or give me a chance to waiver or make a mistake. I wonder what they plan to do in the 28 days0 -

Hi
A similar question really, i have recieved an offer which i am inclined to reject, i was thinking of calling and/or sending the letter offering to accept an ammount 25% less than my claim. Has anyone had any luck with this course of action?
Cheers in advance0 -
I am in the process of reclaiming my charges from Barclays and they have sent me the usual letter about "when I set up the account I was advised about charges etc etc" and have offered a gesture of goodwill for half the amount I am claiming - looking through all the threads there is not much feedback on how Barclays have behaved in these circumstances.
I am a student and desperate for the half but the WHOLE would be life changing - any advise.....................
Many thanks0
