  • Barclays returned my cheque but sent statement. I requested all referral & overdrawn charges for 6 years (around £800). Reaching settlement stage.

    I am now at the stage of waiting for court date, but have received charges since starting my claim.If i want to claim for them does that now mean that i am claiming for MORE than six years of charges, and can i do this.?
    If so who do i write to first..bank or court? and what do i write?:confused:

  • just about to start claim process but just a couple of quieries!!!

    ive never had an agreed overdraft and charges have been when ive withdrawn money even though i knew i had no money in account. does this matter???

    and does it matter how much i go overdrawn, becuase ive heard u can only claim if its a matter of pence???

    and does my credit history play any part in barclays decision to pay out???

    As you have reached the court stage you can't alter your claim now but would need to start a new one. Be aware if you do this after your first claim its more than likely the bank will close your account.

    No it doesn't matter how much you have gone overdrawn. You can claim the fees charged for this but not the interest they will have charged for going overdrawn.

    Not sure if your credit history plays much part in any offer but be sure they will be looking at the overall picture and will want your account kept "clean" after your claim.
  • Sorry to be totally dumb and I'm sure its on here somewhere BUT I've had a letter back from Barclays saying They will have answer or update for me to later than 28th Feb, 14 days is up on 14th Feb what should I do next? do I wait or send another letter? It also thanked me for taking the time and trouble to complain, patronising gits!
    Again sorry for being dumb, I am getting there slowly!

    When i was at this stage, i simply wrote and asked for my statements, and didnt'' send any payment. they sent all my statements three days later and have never asked for any payment.

    Thanks for your advice. I've just checked Money Claim Online and Barclays haven't entered a defence so is it worth me applying for a judgement by default or should I wait a few days to see if they do enter a late defence? Thanks in advance.
  • If Judgement day has arrived - go for the jugular! You've really nothing to lose. If they appeal, then let it go its course.

    To put a member of their legal team into court is going to cost around £200 per hour (4 hours minimum probably) + time already spent (remember they charge £30 ish per letter sent out to you).

    Along with the intangible 'having to explain their charges & losing anyway' that's why they cut their losses, and pay up.

  • Hmmm, I don't know if I've worked the dates out wrongly because when I tried to enter a judgement by default I got this message:

    You cannot request a Judgment by Default at this time.

    The Defendant is allowed 14 days from the date they were served with the claim to defend or admit your claim before you can request a Judgment by Default.

    If the Defendant files an Acknowledgement of Service within 14 days of receiving the claim form, they will be entitled to 28 days from the date they were served with the claim form to file a defence or admission of your claim. If the Defendent does not file a defence or admission within the 28 days you can request a Judgment by Default.

    If you have not requested judgment, the defendant may still file a defence to your claim after the 14 days or 28 days have elapsed. The claim will then be transferred to your local court for a hearing to be arranged.


    As I said in my earlier post, I submitted the claim on 10th January and received a letter saying it had been served to Barclays on 12th January. I thought this meant that the 28 days were up on 9th Feb? :confused:
