  • Hi, this is my first post on the forums although I have been reading the success stories for a while.

    I'm trying to claim around £4000 from Barclays but am worried because, unlike most people on this forum, I haven't received any offer of payment, either part or otherwise. I've got several letters from them saying sorry I am unhappy, they are looking into it, blah, blah, blah, but no other contact.

    Anyway, after the necessary letters weren't responded to, I submitted a claim through Money Claim Online on 10th Jan, which was served to Barclays on the 12th. They acknowledged this on the 17th but have not yet entered a defence. Am I right in thinking that the 28 days they are allowed is up tomorrow, the 9th February? And if they don't file a defence by tomorrow that means I win by default?

    Any advice would be much appreciated, thanks! :D
  • barclays has until yesterday to defend the claim. I submitted a default judgment last night but when i checked today the site had updated and barclays defended yesterday on the last day. I am now waiting for the AQ which will cost another £100.

    In my opinion, Barclays are one of the worst banks to deal with as they take so long. I am claiming £2500 and they have made me no offer at all.

    I'm claiming £2750 from barclays, Exactly the same thing happenned to me.. submitted judgement request at 7.30 am barclays filed defence that day beating the 4pm cut off. They appear to be the craftiest of the banks delaying things as much as poss. I got a letter from someone yesterday though saying any correspondance should be directed at him. Should I send him a letter saying I will settle out of court for £2500 or just keep going with the court process? They orignially offered £1300 before christmas I said I would accept £1800 at that time but they refused..I now want the full amount or at least the majority of it..

    Theoretically you can apply for judgement by default, but if the court receives the defence late. They normally allow the case to proceed. Barclays seem to take the cases as far as possible without going into a hearing. They hope you will drop the case because of nerves. They have not defended one single case in front of a judge as yet. If you keep going, you stand an excellent chance of success.

    I have sent the first letter requesting repayment of my Fees and 14 days will be up at the end of the week. I have heard nothing yet, but i did send my letter to the branch, what would be my next move if i have heard nothing by Friday?
    Many thanks in advance for the answer i am sure i can find elsewhere if i persevere!!

    Recieved reply to my request for statements with my cheque returned and told they will waive charge, which is a good start. Hope they don't delay too much but even if they do I am going to see this through!

    update for you guys, i made my claim for £900. they sent a letter (looked automated) offering me basically half that amount (£480)

    i plucked up the courage to ring them up (which i suggest you all do!) and they were lovely on the phone it wasnt half as bad as i expected. i told them i wasnt happy with £480 as i had claimed £990 and i didnt take interest into account. they said they could see my point and straight away offered £850. i said yes that was more of a fairer figure and that was that!!

    i am happy with the outcome, its not exactly what i claimed but its not far off.
  • Quick update from me, Barclays have acknowledged my claim !!! :D

    Got the letter through this morning stating they intend to defend the claim entirely ! Thats normal I assume ??

    I just hope I calculated everything and worded everything ok..

    Im now off to google the name of the solicitor..... ;)

    EDIT - and I can't find anything out about him at all !! now that IS interesting.
