    Im in a very similar position. i followed martins tips on how to make a claim and sent it to barclays a few weeks ago. i made a claim for £960 (i didnt include interest) and i have just received a letter back today from barclays today offering £480. I am not sure whether i should accept it or not? It looks like its just a stock reply offering half the claim amount.

    Could anyone give me any advice or opinions on whether to accept it. I would be happy to accept maybe £800 or somewhere nearer the £960 but feel that the £480 is just some sort of stock response automatically offering me half of the claim.

    Also Paul could you tell me what you said on the phone to them to get them to raise the offer. Or if anyone else has any advice on what i should say to them that would be great.
  • We have written to Barclays and they offered £1000 for a £4950 claim. reluctantly we declined and replied to their letter stating that we did not wish to accept their offer and they should pay within 14 days or we'd take it to court. They did not respond so we phoned them. They said they had received the letter and they had replied saying they intended to offer us the £1000 again. We are not happy, especially as the woman said "take it further if you like". I advised her that we would! Just filled out the Money Claim form and am very nervous, but hey, what have we got to lose. I keep thinking that i will be the first one that they end up taking all the way, but after reading the advice on this website we have decided to risk it. We've got everything cross as if we win we can say goodbye to the credit card. Good luck to everyone else and if you feel nervous, you are not alone!

    I cannot accept your offer of £1000 as full and final settlement of my claim. I will accept this as part payment and without prejudice, but will continue my claim for the balance.

    Then carry on with the claim. As yet, Barclays have not taken one single case all the way to a hearing to defend their charges. If you continue your claim, and stay strong, you will get the full amount back. Barclays will make you issue a court claim, but they are settling these before the hearing.

    As for Barclays, I haven't had a thing from their solicitors. The only stuff I've had is the AQ from the court with a copy of their defence. Maybe that'll have the details on? :confused:

    Any ideas on this? I'd really like to get it sorted as soon as possible... checked the AQ and there aren't solicitor details on there as such :mad:

    Just read this on the Consumer Action Group forum:

    "The Ombudsman has just adudicated in a complaint against the Alliance And Leicester on a complaint that they closed a customer account in response to a claim for bank charges.

    The FOS decided that the closure was indeed unfair as it was punitve and retaliatory. The awarded £125 against the bank."

    I would like some advice. I am owed £990 (thats without interest) i didnt claim interest I just claimed the amount i was owed. Barclays have offered me half that which im not happy with. What do you think I should do now? I am not a greedy man I would have been happy with maybe somewhere near what im owed (bearing in mind i didnt even add the interest) but I feel that half is just a bit of a fob off. I'd be happy with maybe £800 or something, what do you think is the best way to get this??

    anyone else got any ideas? Its like they just offer half what you claim as a standard reply or something.

    Im not great at haggling over money so any help on how I can get a fairer payout would be great.
