As they say with investments 'Past performance should not be used as a guide' , so whatever Barclays have done in the past, no one can say for sure what will happen in your particular circumstances.
You need to be suitably prepared in case they do.0 -
hi, ive been using money claim online to reclaim bank charges by barclays totaling £1300. A defence has been entered by barclays on money claim online and will be transferred to the appropriate court for continuation. Can anyone advise if this is normal as many of the reports ive read advise that banks dont respond and they dont enter a defence etc etc. What happens now? do I have to go to court??
many thanks for any help

Barclays seem to be entering a defence in nearly every claim now. It seems their tactic is to take the claim as far as possible without going in front of a judge. Don't worry too much, your case is normal.
There is not one single case of Barclays winning in court (that I'm aware of). You chances of success are still very high. How many surrealists does it take to change a lightbulb?

I agree don't panic. It is brinkmanship and I bet that they will fold just as judgement is due.0

I don't think there's a single case of a case actually getting to court yet...0

Yes there is. Natwest won one case last year sometime (quite a while ago), and Citicards won a case in NI late last year, but this is currently under appeal so we don't know the outcome yet.How many surrealists does it take to change a lightbulb?

It is totally normal for Barclays, my brother has just had his payout from them after 5 months, my cousin is due his any day mine however (that was entered at the same time) has been given a court date of April.
Same time scale, same court different judge therefore different course of action by Barclays. But do not worry you WILL win.Real men never follow instructions; after all they are just the manufacturer's opinion on how to put something together.0 -
It's probably worth remembering when starting out reclaiming your bank charges that there is a slim chance that it could end up in court. You have to be prepared to take it all the way."Think for yourselves and allow others the privilege to do so too." Voltaire.0

what will happen if it does go to court? would you have to prove that their charges are unfair?0

What a lot of people have said is to ask them outright to tell the court EXACTLY how much it costs to bounce a direct debit or send you a letter telling you that you've gone overlimit. They won't do it. As it probably costs at the most £2.50, you can see why..
There is a section in the FAQs that deals with what to do if your case goes to court. Also check out http://www.consumeractiongroup.com as they have details as well. You basically have to be well prepared if it does go to court, and able to prove that they've charged you what you've said, and keep a cool head! Most cases don't go to court, but there's always the chance that it will. I filed a claim via MCOL two weeks ago and the BOS acknowledged it a few days ago - if they don't contact me within the next 2 weeks I can apply for judgement by default. Based on my dealings with the Bank of Scotland so far, though, I'm expecting a phone call any day now."Think for yourselves and allow others the privilege to do so too." Voltaire.0
