Firstly, the chances of you actually ending up in court are very small. The vast majority of banks settle before the court date.

I have been reading so many threads my head is spinning!! I must apologise as i am sure there is an answer to my question somewhere but I have a few options and am not sure which to do for the best.
This is what I have done so far;
- 1st letter requesting statement
- 2nd letter sent requesting full refund on charges
- received letter from barclays offering just under 1/2 the amount requested
- 3rd letter - told them I have taken advice from the Citizens Advice Bureau and as a consequence intend to send a copy of their letter to the Financial Services Ombudsmen (FSO) for their advice
- Barclays called me and offered a little more (half my claim), I said I would get back to them
So, I am not sure whether to; 1) accept the the offer as a part payment of the full amount owed, 2) write again saying I will pursue with FSO and see what they suggest, or 3)write the 3rd letter Martin Lewis suggests about taking them to court.
If I take the 1st option and accept part payment, in order to pursue getting the full amount owed, do I then send a letter threatening court action?
I would be so grateful for any advice someone can give me.0 -

Send the 3rd letter in Martins article. You can add into this letter that you will accept their offer as a part payment only, but will continue your claim for the balance (they will most likely withdraw the offer). You can complain to the FSO, but this may take much longer to resolve your claim. One member recently posted they had only just received an offer after complaining to the FSO last March/April. Stick to the advice in Martins article, and you stand an excellent chance of getting all your money back.How many surrealists does it take to change a lightbulb?

if i had gone say £50 overdrawn and got the extra £35 charge, could i still put that charge down? or is it just for unfair charges? like a couple of weeks ago when i went £7 overdrawn and got the £35 charge!?0

You said that they will probably withdraw the offer, presumably though once I threaten court action they may then offer the full amount?

It would be pretty amazing if you lost anything. Barclays have not once taken a case all the way to a hearing in front of a judge. They may play games with you, but your chances are very high.
They will probably withdraw the offer because you wont accept it as full and final settlement of your claim.How many surrealists does it take to change a lightbulb?

I was just wondering if Barclays typically close accounts after you claim your unfair charges back. Does anyone happen to know?:o0

Hi - had a quick scan through the Barclays thread at the consumer action group and it doesn't appear as if they are.
