This is quite standard now for all the CC companies to do. I would press ahead for the full amount. No company has been to court yet to prove their costs are as much as £12 (except one claim in NI that is currently under appeal). They are still settling in full if you push on.How many surrealists does it take to change a lightbulb?

Hi there,
I closed a Barclays account several months ago which i have now calculated accrued £475 (without interest) in charges over the last 6 years.
I have assertained from the threads on this site that I can claim this back.
My dilemma is that I also have 2 other barclays accounts. I have a graduate account with a £3000 overdraft, which remains mostly up to the limit, I cannot afford to pay this back. I also have a business account as i am self employed.
Is it too risky to pursue this? i'm stuffed if they close my other accounts down, but would this be treated separately because it is a now closed account?
I look forward to some words of wisdom...
Thanks,
Sam0 -
Hi Sam
Not sure how Barclays deals with closing accounts - I know that some banks do but not all of them. Check out the consumer action group - there are people there who have claimed back from Barclays and could tell you more.
There are some banks that will open you up a new account and transfer everything over from your old bank, including overdrafts etc. That could be worth pursuing, too.

arrghh another £100? it seems like were throwing good money after bad and i can just see with my luck i will end up losing more money if we dont win (does anyone know if there are and cases where the claiment hasnt won?)kakriska wrote:Im at the same stage. Barclays defended the whole claim so it has now been transferred to my local court. I have hadto fill in a questionaire and send it to my local court with another £100.00 (which I've had to borrow from my mum!). I have said that I want to claim this back also but am now waiting for a hearing date. What happens after that I'm not sure about. I have come so far so may as well see it through to the end. Good luck with your claim.
Well thanx for letting me know what is yet to come and good luck:)0 -
The last day for them to receive my AQ was today (I sent it last week) so hopefully I'll get a court date pretty soon!0

Don't worry, many claims get to the stage where you need to pay a court fee. It means you're close to getting your money back.
To answer your question, yes, a very small number of people have lost, but in both of the two most publicised cases, there were exceptional circumstances.
The first, the defendant didn't prepare properly and the bank got away with a defence that is now easily fought. The second was in Northern Ireland and is currently under appeal.0 -
hi, i have obtained copy statements from Barclays and i have added up all the charges - £3135!! No wonder I was in a financial pickle. Anyway, when i send the letter do i have to list all the charges seperately, or can i just return copies of the copies with the charges highlighted?
Also, has anyone ever tried to ask for a settlement figure right at the outset? i.e. suggesting you'll take less if they stump up immediately.
Incidentally, itt was interesting to see how, as the years progressed, that the charges went up - initially from £20 in 2001 to £35 in 2006. This certainly made the calculated charges shoot up - in 2001 in takes 5 charges for a £100 pounds, by last year it takes 3. Also noted that my account fee had gone up from £7.50 to £10.50 although i certainly am not getting any more service for my money!
Cheers

It's best to list them all out with Date, Charge Name and Amount plus a total. Also, has anyone ever tried to ask for a settlement figure right at the outset? i.e. suggesting you'll take less if they stump up immediately.
Yes, a few people have with varying success. If you press for the full amount, it's very likely you'll get it though. Just remember to follow the instructions carefully and not skip any parts.0 -
It's better to list out the charges. HERE is an example of how I do this using Word (total all the years up at the end).
If you want to settle for a lesser amount, it won't hurt to try this from the beginning. This is a personal choice whether you do this or not.How many surrealists does it take to change a lightbulb?

Hi, Please can someone help me...I know this has been discussed before but when I'm reading all the other posts I get really confused. I have started proceedings against Barclays and have just found out that they have defended the claim in full. There deadline was tomorrow and they did it yesterday..... What will happen now? I will get an allocation questionnaire right? And how do I fill that in, what do I put on it. Will I get a copy of there defence? What documents do I need to prepare to take to court with me and how on earth do I get hold of them. SOrry, I'm really panicking abit now as I don't actually want to go to court. They owe me just over £1800 including interest and fees so far, Me and my family really need this money so I'm sure you'll understand that I don't want to lose it because I did something wrong or left something out. So any comprehensive advice would be great. ALso can anyone tell me if anyone has lost a claim so far against BARCLAYS?
Thanks for your help.
