    Hello,
    I would ABSOLUTELY stand my ground. Think of the billions banks make and think of how much that extra £2,000 will make a difference to you!. That extra £2,000 could buy you a fantastic holiday. Pay off part of a debt, pay off a chunk of your mortgage.
    I know it's a bit scarey but if you DON'T accept their offer they are NOT going to take you to court. (unless your incredibly unlucky and become the first person in the country to do so).
    I'm not going to accept a penny less than what i am claiming.

    Worst case scenario....... even if they did take you to court you would win!.

    Hope this has bulstered your resolve.:rotfl:

    My friend has had to take them to court for the grand sum of £70! No offer was ever made for it, they defended and indeed he is now awaiting a hearing date, been going on 5 months so far, it must have cost them 4 times that and more for solicitors fees. :confused:

    While your chances of not going to court are very good, its simply not the case that no-one has been to court and people have also lost.

    However, as its not the best offer I've seen I would suggest that Shambo does carry on and refuse the offer.
  • Hi all. Just a quickie to say thanks for the advice from everyone involved so far. I started my case after hearing about the situation on the radio by sending an email to Barclay customer services basically saying 'give me my money back'. Three days later I had 6 years of statements through the door and 2 days after that I had the standard £1000 offer. Three days ago I wrote back accepting this as a part payment against the total sum of £2880 and after 'careful consideration' which must've taken a matter of minutes because they replied on the same day, they said they couldn't advance on the £1000 and even though the offer is still open they understand I might have to proceed to the county courts. I've just finished filling in the court documents and paid my £120.

    I can't emphasise how much help this forum has been. I'm zipping backwards and forwards through threads like you would a good book. The amount of encouragement flying around is unbelievable and it's making this whole process more of an adventure than anything else.

    A case against Natwest last year lost. The bank threw in a sneaky defence (which they haven't repeated because it is easily rebuffed, and they know they were lucky to get away with), and the claimant wasn't fully prepared for the court.

    A case also lost at the end of last year in NI against Citicards. This is currently under appeal so we don't know the outcome of this yet.

    I didn't mean to make you feel uneasy but it does have to be remembered that you are taking your bank to court and you do have to be well prepared for this and not assume you will get an offer before hand :D

    Now it’s time to get legal on their backsides and actually go through the court process. Do it right and this is a simple online process, and in most cases the banks will not contest your case. Yet don’t take it too lightly, you are still about to take a bank to court!

    However... by reading MSE you, of course, will be well prepared :)
  • hi all,
    i have recently gone through the process of claiming my bank charges back from barclays. All steps taken as described on the web site and i recieved a letter today saying that, The defendent has responded to the claim indicating an intention to defend all the claim and that they have 28 days to to file a defence.
    is this normal so they prolong the payment and hold out for as long as possible and try to scare me off. i currently have a loan with the bank could it be something to do with that?
