    Hi Lizzy,

    Barclays dragged their feet with my statements to. Legally they have 40 days to get them back to you. It was slightly less than that for me. Hang in there - they will arrive. They might even send the cheque back (I got mine back).

    I don't think you'd have to pay off the overdraft before - perhaps a more experienced person could comment. I have an overdraft with Barclays and have just submitted a claim via moneyclaim.
  • Barclays have responded to my MCOL claim, they intend to defend (as predicted), is it 28 days from when they responded or 28 days from when they were served papers? (e.g. is it a 14 day extension to file their defence?) Do I just sit and wait for the allocation questionnare etc or do I need to send off my evidence (previous letters/statements and recorded post slips etc) somewhere in the meantime?

    Don't send off anything at the moment. If Barclays enter their defence (probably), you will receive an allocation questionnaire from the court for the next stage.

    Im at the same stage. Barclays defended the whole claim so it has now been transferred to my local court. I have hadto fill in a questionaire and send it to my local court with another £100.00 (which I've had to borrow from my mum!). I have said that I want to claim this back also but am now waiting for a hearing date. What happens after that I'm not sure about. I have come so far so may as well see it through to the end.     I went into Barclays with my daughter the other day paid £5 and they are sending me statements through the post. Looks like we have a long haul ahead of us.

    Im just about to send my first letter asking for the statements..but I've been putting this off for ages as I'm 'not very good with banks' and tend to get confused with all the things they say ...I had to take my best friend with me when my marriage broke down ..jus to transfer names etc...

    basically i have two accounts both of which are OD .. the first one has my wage and all my DDs/SOs coming and going ..but has an overdraft of £600 which I took over the limit by £200 and am reducing this month by month at £40 ..(eg Dec..£680...Jan £640 ...etc) this was taken over by the debt recovery department.......Before Christmas i was only £308 OD..but went over the limit and was charged, yet another, £30 !! surprise surprise!

    My other account has an OD limit of £1200, which I am paying off at £100 per month..currently under £1000

    Will I still be able to claim back any charges even though I owe them money? I have been in a couple of times to sort my finances out ... so they know I am struggling.. but I felt they were very unsympathetic.. reducing me to tears ............so you can see why im cautious.

    Also, if they close my account(s) I am worried about my mortgage etc... I can't afford to lose my home....

    I don't mean to sound paranoid..I'm usually a strong person..but because of my personal situation I am feeling quite vulnerable.

    I also have something called an Openplan account (the Woolwich) which I was advised to take out when I remortgaged my house thro Woolwich (which I beleive is now part of Barclays?!) I have no money in/out of this account but it has my mortgage amount on the statment under 'borrowing'

    Please if anybody can guide me through all this I would be very grateful....

    You can reclaim your charges but must be aware if you are in debt with the bank they are like to want their money back.

    All banks can, and some do close accounts and withdraw overdrafts however provided your mortgage account doesn't run into arrears this is a different agreement and will be okay.

    Presumably this is your mortgage account.

    I understand and accept that any charges I receive will go towards paying off my overdraft on both accounts.... but

    what if the amount is not enough to pay these off? How will i be able to repay the balance?

    How do i go about opening an 'umbrella account', do i need to ask barclays to transfer all my DDs etc? (can u recommend a good bank? lol)

    I have a Yorkshire Building society account which only has £11.00 in it...could I use that as an umbrella account?

    As I have two accounts with Barclays...do I send a letter asking for statements for each account, therefore sending two seperate cheques for £10?

    Also one of the accounts was a joint account .. until 2 years ago since my husband and I seperated.. it was transferred to my name..he signed a form to say this............will I be able to claim back charges from when it was a joint account?

    One letter with both account numbers, and one £10 payment is fine (Barclays will return the payment because they are providing this data for free)

    It is fine for you to claim off the joint account in only your name.

    Got a response from Barclaycard offering the difference netween the OFT suggested £12 per charge and what I have been chrged. Anyone else had this?
