    I wont claim to have read every post but Ive read quite a few and from what I have seen the banks have yet to take it to court, most seem happy to let you sweat it out until just before the actual hearing, they then offer you the full amount.
    My view is they are playing the odds and obviously feel in court they are currently stacked against them, we're better off claiming now because the odds are in our favour they will not let it go to court but they will make you sing and dance before they pay you. I also feel these odds are slowly being chiselled away with every new claim made.
    Its a case of they can't afford to lose in court because that will make everyman and his dog claim knowing they will definitely get their money whereas now anyone who is a little apprehensive or unsure about claiming may not do it.
    There will come a point though when at least one bank will be forced to draw the line and go the whole way.

    Agree ,
    I also think no bank wants to be the first to "win" in a court against their own customers as this would be a PR nightmare for them being portrayed as the nasty bank .
    Its "win win" for consumers at the moment though.
  • Hi guys, a bit of an update on my progress against Barclays...

    Got back today to see a 'Notice that Acknowledgement of service has been filed' letter waiting for me, and that Barclays has 28 days in which to file a defence.

    I'm just wondering when I can expect the Allocation Questionaire might turn up? Does it get sent to me automatically when they put in their defence?
  • You can add in the new charges when you fill in the final claim on MoneyClaim.

  • I have now received the questionairre to fill in and send to the local County Court with another fee of £100.00! can I claim this £100.00 back? Can anyone please advise on the next step of the procedure, I feel a little dispondent at the moment are the odds stacked against me, is this an uphill battle and that I will tumble at the last hurdle?

    I came accross THIS THREAD yesterday concerning one case involving Barclays. Basically, the judge seems so annoyed with all the bank claims, and the fact the banks are settling before any case gets to a hearing. He has ordered Barclays to produce a list of every case they have taken to a hearing, and the result of the hearing. If they dont do this, he will strike out their defence, and give judgement to the claiment (the banks customer).

    I really hope a few other judges see this, and deal with the claims in the same way. Further in the thread, the person whose case this is says he phoned the bank, and was told that all the claims that come in front of this judge are going to be dealt with in the same way. This could be excellent news for anyone claiming through Lincoln County Court!

  • Hello Guys & Galls,

    New to the site but have learnt alot from it in the last few days..!! Thanks..

    I'm claiming from Barclays for 6 Years worth of charges totalling £845 + interest of £190 give or take...

    Got bank to send statements free of charge (Spent a few hrs going through them with a marker pen, then a few hours in despair at the total..!!)

    Sent Martins letter and got the standard reply, "get back to you", felt tolerant so waited for them to reply outside of my given date..

    Got a reply offering £410 (less than 50%)

    Tried a different tack, writing to them asking for a £700 settlement under the terms that they did not close my account, and for a mutual benefit, oh and say that we could still be friends ; )

    Got a letter yesterday, telling me that "I regret that I am unable to agree your request" And reiterating the offer.. Closed by a similar reply that I read earlier in the forum "if you do not wish to accept this offer and you now intend to start legal proceedings it would appear we are unable to reach an amicable resolution"

    So 20 mins ago I submitted a Claim on MLO for the full figure..!! Dohhh What am I doing...

    Not really sure what happens next even though i've read all the forums that I can before my eyes start to glaze over (Rex's step by step is helpful)..!! I'm surprisingly not feeling bothered, just wanna get it all right, so I can kick their robbing bottoms from here to New Mexico..!!

    Good luck all..!! Just going to crack open by Christmas single malt, to take away the pains of the £120 Court Charge..!!

  • Don't worry, I felt the same when I started my claim for the full amount (except I had a really strong gin after my £80 charge!) but it's coming along nicely - had a letter to tell me that Barclays have 28 days to enter a defence, which they will, and then we'll continue until I get my money back - can't wait!

    I think the next step for me is the Allocation Questionaire but I've been reading up and think I'm ready for it...

    Great site & have lurked for a couple of weeks until I received my back statements from Barclays (requested 181206 & received two days ago - they have charged me a fiver for these).

    Gonna post off the first letter tomorrow although from what I have read in recent posts is it best to deliver by hand & get a receipt?

    Just my luck to hear Barclays are the one of the 'tougher' ones to deal with - any tips greatly appreciated!
