YES most definately...
I'm not proud to say it., but i was delibrately bouncing cheques from bank to bank, just for after three days and the cash cleared i had some extra money to play with, i was of course charged for the cheque not going through and incurring more debt to the account, often £100 a month through this....
I claimed and won.
ANY charge no-matter how much it was your fault delibrate or not can be claimed for and WILL be awarded.
cheers

ive accepted an offer of£1,500 from barclays bank as i was nervouse about taking to court for full amount of £2,800.
since ive accepted the offer someone has told me that i can still go for the rest even though i have accepted the offer 'in full and finall settlement of my claim'
is this true?
if so how do i go about it and what do i put in the letter?
looking forward to your responses
thanks in advance

As you have accepted their offer, presumably confirmed in writing I don't see how you can then go back and claim for the rest.0

Hi all, i have just had a letter from the court saying, notice that aknowledgement of service has been filed, so now barclays has 28 days from date of service to file a defence. They have a ticked the box saying they intend to defend all of this claim, I just wondered if this has happened to anyone else? and what was the outcome? what should i expect next?
Thanx0 -

Barcalays like to play the half charge.... Annoying as I bet you really need the money too and someone waving £1500 in front of you is too tempting.. IF you can wait a maximum of three months go to court!!!!0 -

You made a claim against Barclays for £2800. They offered you £1500 as full and final settlement of the claim, and you accepted. The key words here are full and final settlement. This means that claim for £2800 is settled as far as the bank is concerned because you agreed to their (rather low) offer.
You can try for the rest, but I wouldn't hold out much hope for success. This would be VERY EASY for Barclays to defend in court. They have proof of your acceptance of their offer to settle the claim. Once they show the judge this, I'd say you are stuffed. How many surrealists does it take to change a lightbulb?

EL, not that I have been that far myself, but that seems to be the maximum it will take to get a settlement via the courts. Would you not agree?0

It can take much longer than three months in court. If a claim went as far as getting a court date, depending how busy the court is (they do seem bogged down with these claims), it could take one to three months over that time limit.
Even back in December, some people were getting court dates in March. This is on top on the first period of 14 days for the bank to respond, an extra 28 days to enter a defence, and another 14 days+ for the AQ to be filled in and sent back (and seen by a judge). How many surrealists does it take to change a lightbulb?

I took it as read three months being the maximum, as I could not find a case here or at Consumer Action staing any longer?
..I will take your word for it, thanks for the update.0
