It is just a scare tactic. Go ahead with your claim as normal, and move onto the next stage. How many surrealists does it take to change a lightbulb?

Proceed with your court claim. They are trying to scare you/put you off. Ignore them and run your case under your own terms, not theirs. How many surrealists does it take to change a lightbulb?

Barclays have offered me £1,000, of a claim for £2,305. I am not going to accept this but they have threatened to take the case to finaicial ombudsman if I don't.
Should I proceed or is this just a scare tactic?0 -
Rex_Mundi wrote:If your claim goes as far as a hearing. You MUST turn up. If you don't, your case will likely be struck out by the judge, and you'll lose. You can have someone go along with you as a lay representative to speak on your behalf, but you must be at the hearing as well for them to do this for you.
Don't wish to doubt you mate, and I'm probably reading it wrong. But in the course of my research I've found a few pieces that say if you give the Court and Defendant at least 7 days notice, the case can be heard in your absence.0 -
Right..had letter from Barclays..a couple of days late but makes no difference.
It says sorry I'm unhappy with the charges..they disagree with me..I signed saying I agreed to be charged blah blah blah...HOWEVER...we offer you £1000 towards the total amount I am seeking.
If I sign the form saying I agree and they put the money into my bank account within 7 days..are you all sure that I can still chase them for the rest? Do you advise me to accept and chase them?
And how would I go about calculating the remaining charges if I accept the £1000 now?
They know they're in the wrong, they wouldn't have offered the grand otherwise!0 -
Oh...If I accept this £1000..will they close my bank account immediately???
Cheers guys0 -

Only you can decide if you want to continue through the court process.
You can accept the £1000 in partial payment and carry on taking them to court for the remainder of what you have claimed.0
