  • I have taken Barclays to the small claims court, asking for nearly £2k in bank charges. They have accepted my claim, and have just over 2 weeks to state their defense. I know they will probably do this and the whole process is going to get drawn out until a court date is set, they fail to turn up and I win by default.

    Question: has anyone attempted to shorten this protracted process by contacting the bank and trying to settle during the small claims procedure? A lawyer friend of mine said there was nothing to be lost from contacting them once more and having a 'without prejudice' conversation in which we try and thrash out a settlement. Before taking them to court I offered them a settlement of £1300, which they rejected (offering me £700 instead). They know as well as I where all this ends (they've paid out nearly £500k in reclaimed charges already). Is there anything to be gained / lost from restating my offer of settlement for £1300?

    Any thoughts appreciated.

  • Yes, several users have rung their bank and said no to the first offer but would accept £xxx and have been successful

    My situation in a nutshell:
    I have incurred £1800 of unfair bank charges from Barclays bank.

    I offered to settle for £1300. Bank came back with £700 offer. I rejected and have started small claims process.

    Bank have just accepted claim and I assume will mount defense leading to protracted process ending in a no-show from them at court.

    Question: is it worth me calling Barclays up and re-stating my original offer of £1300 even though the court claim has officially started.
    I am deadly serious about taking them all the way, but wouldn't mind saving both of us the inevitable charade of going to court.

    A lawyer friend of mine said I have nothing to lose in having a 'without prejudice' conversation with them to try and reach an out-of-court settlement even at this stage.

    Any advice?

    personally i wouldnt but it probably cant hurt.

    as they ignored your offer why not take it all the way and go for the full amount rahter then £500 short?

    I wrote to Barclays and requested £1300 of recliamed charges including interest.... they have written back within a week and offered £430 in full and final settlement.

    What do you people think I should do? My overdraft still sits and -£1900 so I'd quite like to hit a dent in that... that account is virtually dormant now.

    Any advice would be gratefully received, as always!!

  • It is probably worth while refusing this first offer and see if they come back with a better offer but as always the decision is yours.
  • Hi - I too have had a letter offering £1000 in full and final settlement. I had written asking them for details of my charges over the past 6 years, and this offer came as a result of my request for information. I haven't received the information, but surely the offer of £1000 indicates to me that they KNOW that I am due much more. However, I sent a second request for the information, and attached a £10 note (they could have bounced a cheque and charged me for doing so!)
    Anyway, I have not accepted the offer. I have since received a phone call, at 6.30 p.m. from my local branch inviting me in to discuss my referral charges. I told them I had commenced the process to recover these, and she said "yes, I know and we really want to talk to you to see how we can help". I agreed to go in on the 1st Feb and the lady said she would write to me to confirm the appointment, who it would be with and where it would be. That was two weeks ago and I have had nothing! So I don't know where to go and who to see. We have a branch and a business branch, and I use both as they have the same sort code. Do I turn up at one of these, or is this just a delaying tactic on their part? The lady did mention that she had the information I had requested and it would be available for the meeting, so obviously they have it to hand. Should I drop them another letter and ask again for the information based on their approach to me?:confused:
  • Barclays have filed a defence in response to my claim through Money Claim On Line. This means apparently that I will now be sent a Court date. How likely is it that I will actually have to go to Court or is it more likely that Barclays will settle prior to the hearing date? Has anyone else been in this position? Has anyone actually had to go to a hearing? I would be grateful for any advice/other people's experiences. Thanks.

    I have just sent off the first letter to Barclays requesting the 6 years of statements. From what I have read on this forum, they send back a standard response and then return the cheque with your statements. I just wondered if there is any way we can get these statements quicker than waiting for the 40 days? The response people are getting from Barclays seems to say that you can ask for copies of your statements without having to pay for them (well if you are still banking with them anyway!). My husband has gone into his online banking to see if he can find a way of ordering them but couldn't.
    Anyway, did anyone do anything to get the statements quicker or should we just hold tight?
