The banks have done something wrong, they have unlawfully charged you for going overdrawn!0 -
You need to start by asking for all the charge details on your account and take it from there.

With one of my letters, i sent off my list of charges with interest that i printed off with help of this GREAT site:T . Now the bank have filed a defence(that i would assume is a template for the bank) and in that defence they state " The defendant puts the Claimant to strict proof of each charge and the date thereof"
Does this mean that i now have to send a copy of my statements? and if so, as these statements are documents of Barclays bank, and i am self-employed; can i charge them for my time and cost of paper and ink?:DNot just a white vanman:cool:

You would normally have to enter all your statements as part of your case anyway (they carry proof of your charges). Don't worry about this until you get to that stage. You will be sent the allocation questionnaire next. How many surrealists does it take to change a lightbulb?

i have the AQ already but didnt know if i need to send them in with AQ or if i could charge the bank for making two more copies. but i sent in my request for judgement before banks defence and court have processed the defence before my request for judgement even though the defence was 2 DAYS LATE.so the court are asking a judge to make a ruling on it. fingers crossed.
Mean time i still have to send in AQ.
MANY THANKSNot just a white vanman:cool:

Hi,I Have taken my bank to the small claims court and have just found out they are defending the whole claim for £4,700. can anyone advise me of the next process? it's against barclays.
thanks
Barclays are defending the whole claim and I have now received the questionairre to fill in and send to the local Court with another £100.00!! Can I reclaim the £100.00? Can anyone advise of the next procedure. Am I fighting a loosing battle here because I feel like it's a never ending up hill struggle. Will I fall at the last hurdle?
The bank initially offered me £1000 as 'a gesture of good will' can i still accept this as partial payment or would that jeopardise things?0 -
Rex_Mundi wrote:Just send the AQ at this stage. You don't need to send anything to the bank at this stage. There is a guide to complete the AQ HERE (post #8)
i have filled it out on-line and printed it of as it looks much better
many thanksNot just a white vanman:cool:

I got a letter from Barclays HQ saying they cannot guarantee they will meet the timescales set out in my letter.
Is this a standard letter and is it likely that they will come back with an offer to keep it out of court?
I did claim back a rather large sum
Sounds like a standard letter, carry on with your timescale.0 -

If i take the next step ( 2nd letter - without interest ) in Martins ( excellent ) advice - I have to threaten to take it to court.
No problem, I can fill out the letter template.
Except where I have to put the name of the court ! What should I put in there ?!
Also, they've offered me £1000, which i'd like to get hold of as a partial payment of what Im owed ? Is there a template for that kind of letter ? thanks....
Fill in your local court or leave that phrase out. As regards partial payment just say you are happy to accept the £1,000 as partial payment but will be progressing to court action.0
