    Started this process only a week and a half ago and received a letter and my cheque back from Barclays two days later and then lo and behold got my copy statements through on Friday. Has anyone else had such an "efficient" response? I wasn't expecting anything until just before Christmas...

    i was surprised to at how quick they dealt with my request posted letter Friday call from bank on Saturday saying passed on to head office statement arrived week later. Sent initial request for refund 19/12/06 recieved response by 28/12/06 then 04/01/07 letter offering goodwill payment. Hope they are as quick now I,m threatening court action for full refund.
  • Okay I have now had the allocations questionnaire to complete - dont have a clue what to put in section G have been to CAG site but am even more confused now as i only claiming 1000 any help would greatly be accepted. They have stated in there defence :

    1 - Particulars of claim do not provide details or particulars of the account _ should I have put that in my original claim form??

    2- The really scarey point at the end - if they win they will be claiming costs from me whcih may cost more than what i want off them.

  • Also they say i can not claim for stuff prior to 4 dec 06 the date on the court application where as I actually started requesting the money from 16 Nov can any one advise on this
  • why is it that barclays seem to pay up quickly and easily for some but not for others ? I am only claiming 1000 so whay are they making me go to court where as some who want 4 or 5 k seem to get it
  • I am about to send my second letter and am a bit confused so need some help. Part of the letter reads

    This is based on the Unfair Terms in Consumer Contracts Regulations, as I believe these default charges are unfair and not proportionate to your costs, and therefore the [INSERT NAME OF COURT] court will rule in my favour.

    What do I put in for the name of the court?

    Bank had till the 3rd jan to put in defence and failed. so i phoned the court who told me to send in request for judgment or fax it over to stop bank getting in a late defence. so i faxed it over on the 4th and phoned to confirm it had been received, and it was received.
    Then today i get a letter from the court with the banks defence that was received 2 days late on 5th jan.:mad: As you can imagine i was not too pleased this morning and phoned the court to give them a few choice words. After they did a few checks i got an appology and they now have to give my request for judgment to a judge to get judgement, as banks defence was 2 days late, but the problem is they have already posted it back to me.So when i get it in the post tomorrow i have to return it a.s.a.p. fingers crossed.

    Anyone else had any promlems like this, or am i on my own with this one?:mad:

    I did speak to the court today (thanks to whoever suggested that). They said that the bank has 30 days to pay up if they don't want the CCJ to be permanently filed against them, but they should pay up immediately.

    I just wish I had one more template letter I could send to the bank. Feel nervous about writing something myself.

    Go to my post here (link below) about low charges.. its not 100% money back but I got half of my charges back, so kind of a success story! Face to face or by phone seems a good piece of advice as MSE Martin has said regarding first time charges. (not sure if yours is a first time charge but maybe worth a try anyhow?)

    ps. someone I know also recently got charged £60, they have incurred charges many times before, they got £30 back after going to the bank to ask for mercy. (which reinforces my feeling that I should have been let off completely for my first time charge!)

    HALIFAX Statements request letter sent 30 March. Statements received 05 June 1st Letter sent 03 July 07 2nd Letter(threaten court action)sent 17th July 07

    Statements request letter sent 03 April. Statements received 26 May 1st Letter sent 27th July 07!
  • can anyone help please - I sent my letter to Barclays requesting copies of my statements and they sent a letter back stating that they were not under obligation to present information and that my request to assemble a list of charges was turned aside. However they have sent me copies of statements but frankly they make no sense whatsoever - I presume this is their way of getting around things - can anyone please advise? how do I obtain proper copies of statments so I can see charges?
