I wrote to barclays to ask them to pay back my bank charges and consider my case now rather than after the test case due to financial hardship, for which i feel i have a good case. they wrote back to say they would deal with my financial hardship as a separate issue to my reclaiming bank charges and wouldn't cosider my case until after the test case. The stupid thing is if they paid back what they owe me it would almost cancel out what i owe them! What do i do now? I thought they had to deal with hardship cases.0

Am in a similar position and have just spoken to the FOS for guidance - it IS separated out, so you can either pursue the first reclaim ie. threaten/go to court, OR (as barclays replied to me) send the bank details of your financial situation (they sent me a budget planner) and their remit is (I'm told) to "try and relieve your financial stress". Reading between the lines here, re the latter I suspect they will try to rejig your finances but NOT refund any charges, since that would save them money, never mind you (may be wrong here - any other experiences of this?). If it was pursued by you to court re complaint over charges, I understand the waiver allowing them to suspend the claim is overruled SHOULD your position of financial hardship be held valid (I phoned the FOS to check mine was). BUT if (as with me) the bank is "appearing" to help, and asking for info "to do so", then if I don't provide it it may be seen as me not accepting that help - am in a quandry now myself!! Personally am tempted to stick to the threaten court route stating is in the hands of the CAB (as mine is) ie. beyond the bank's help, and since am info'd my hardship claim is valid then should be in my favour....Also, both Citizen's advice and the FOS are prepared to pursue these issues on your behalf - CAB said the official notepaper seems to have an effect and have had a good response rate - think their processing time is pretty slow due to workload though....Was going to post re this myself, so any further guidance appreciated (espec. re how barclays in particular tends to respond ie. do they capitulate in the final hour more often than not??)Also followed a link from here to the Consumer Forum: bank charges action group - any one found this useful? Picked up you have to buy the book to get the guidance so was a bit put off....0

Yes, I had a letter like this arrive at my door a couple of weeks ago, it was not only the £8 overdraft charges that will take effect from August I think? but also the chance to use Barclays new 'Personal Reserve'.. I definitely won't be using this service though. At least not until I get my charges back..0 -
Not sure I should respond on thread, but if you opt out the bank can return up to 5 items and charge you £40 per day(ie return items x5), if you have items on a number of days consecutively, it COULD potentially be more expensive than having the reserve as other providers COULD charge you for not receiving a payment.
You have to look at everything and decide what is in the interests of you and not base it on what the bank have done previously.0 -

Ok,
I'm going at Barclays sort of on behalf of my boyfriend. He's been with Barclays for about 5 years, whilst he was a student (but not a student account). He's overdrawn but slowly paying it off but over the years has been charged over and over for 'unauthorised overdraft charges', most of which were incurred due to them taking out the fees when he has been at his overdraft limit! So they kept him in a perpetual cycle of owing them charges...
Anyway- enough of how evil they are, I'm about to send a request for the charges for the past 6 years...cross fingers for the next 40days!
How much success have people been having clawing money back from Barclays? I haven't been able to read 2 years worth of thread posts...but from what I gather it's been of moderate succes.
