    you can take the bank to court. the case will be suspended. the current trial judge may or may not allow cases to continue when he makes his ruling around easter. its not simple.

    Is it the best option? or is it better to wait?

    Get the court claim in asap.

    If you wait, some of the charges might become statute barred if they are older than 6 years by the time the test case is done. If you get the claim in now, they will not become statute barred. The claim will get stayed, but it will still be accepted.

    All the charges I claimed were within the past 2 years, time is not the issue in this case.
    I'm a little worried whether I manage to go though court case.
    It was easy to send a letter to the bank with my demands, it gets harder to go through all the way (court)
    If I won't put my claim in court does it mean that after all that time I might not get the money at the end?

    I have told the courts my new married name and address. No response so I've sent it a couple of times to make sure. Barclays obviously know my new name and address.

    Do I need to let the solicitors know too? I'm pretty sure they have access to updated info but I've lsot the piece of paper witht the guys name on it and phone number for Barlclay;'s litigation team.

    1. Do I have to let them know too?
    2. Can someone give me the litigation team's number?

    Hello Elaine...

    My advice would be to stick with it. £275. offer is a joke - and they know it.
    Of course it will be a risk going all the way (to court) but everyone that goes to court knows there is a risk. It depends on how good a case you present ( and now of course the outcome of their so called test case ).. but this is what the banks are counting on and hoping you and others will be scared off.
    We have to not let that happen!!

    Personally yes, I would accept an offer... but it would have to be a damn good one... not derisory like that. ..

    Let us know what you decide.. and I hope it goes well for you whatever..

  • I recently wrote a letter to my local barclays using the letters given in claiming bank charges.
    Today I got a letter back from the local branch telling me my complaint has been redirected to "Retail Bank CR DC Complaints Gateway". They gave a time frame of a few days either via letter or phone call with a resolution or next steps.

    Im assuming everyone who has recently written had their claims moved to the complaints gateway?
