Hey debsmary, reetproper is correct in saying that this is only a part payment offer and that if you do wish to go for the full £9,694 you need to write to them saying you'll accept this offer 'without prejudice' but will contine your claim for the remaining amount.
"I'm afraid I cannot accept £3660 as a full and final settlement of my
claim. I will accept this as a part payment and without prejudice,
but I will continue my claim for the balance."
To which i am positive they will reply withdrawing their offer and therefore making you go to court. Just remember that the court road can be a very long road. I believe that the banks will still make us go all the way to court to get our money back if we want the full amount, as this test case is only deciding if the banks contract with us customers falls under the OFT's ruling and not if the charges are actually unfair, and therefore will contine making us go to these lengths in an attempt to put as many people as possible off claiming (i'm sure many people have read a letter from their bank and thought 'i'm out of my depth here' and given up) and this will contine until the OFT finally say's what is a fair fee for the banks 'service'. (Here ends my rant! ;-) ) I must add that this is only my personal opinion on what i THINK will happen judging them on past experience and that you should make your own mind up on what you think the banks will do. Whatever you decide to do you MUST REPLY to this letter or else they may assume your dropping your claim and you'll have to start over from the beginning. Good luck0 -

Hi everyone
Just received the post, a letter from Barclays saying will cost us and them lots of money if we pursue the claim to trial. They are therefore offering to pay £3720, (includes £120 court fee) The actual amount claimed is £9694.
It is 'without prejudice'. It does say The total amount of your charges is £3660. This is clearly wrong, possibly mixed us up with other claimants? Or only partial pay out?
Anyone else received similar offer?
Still thinking what to do at the moment.
Same has happened to us. We put in a claim for £1050 in June and they recently offered only £275.00. We have replied twice stating that we will accept as part payment etc (as advised here) but they will not budge. It's take it or lose it. My husband doesn't want to go to court over it.
What I'd like to know is why are they picking on some people and paying up with others? Isn't this discrimination?

I posted my letter and today had got a looong letter back:
1. they have acknowledged a receipt of my complaint
2. they have asked FSA to suspend the normal timetable for dealing with bank charges complaints which they have agreed to (I don't really know what it means to me)
3. once the legal proceedings are completed they will resolve my complaint (no time given again so I don't know how long I will have to wait)
4. If I choose to issue a claim in the County Courts Barclays will immediately apply to court for an order to stay my action until resolution of the bank's proceedings with the OFT.
What does it mean to me?
There are 3 pages written in bank slang wth word I don't understand?
Is it good or bad news for me?Information - never enough, questions - always too many, decisions - not always the best

I have been claiming against Barclays it seems for ever, talk about dragging things out.
I was awarded a Judgement for Claimant (in default) on 31/Aug/2007
I sent a warrant but it was returned followed by an Application Notice
asking for the case to be stayed.....etc
After Judgement has been awarded???
Help!!!!!!!!!!!!
PS anyone know if Bank of Ireland can be claimed against as not a UK co.?

What does it mean to me?
It means you have had your complaint suspended until the OFT case is resolved.
