I have a few questions about my claim. I got up to getting a court date but it was stayed by the bank last year a day or two after the test case was announced by the OFT and would like to know when i can contine my claim...is it after the test case is finished or do i have to wait till the judge gives his verdict and if the banks appeal that decision will i have to wait untill that appeal is dealt with, which i have read could take upto 12 months? And will any charges i paid 6 years+ be still claimable by then even though i informed the bank of these just over a year ago now? (started claim on 13/01/07) I'm just wondering if the banks are buying more time if the stay on claims does stay in affect while the appeal etc, is on going and therefore putting peoples claims out of the time limit as i know they have argued this point before after it took people months to get a court date.
I'm not too worried myself about this as most of my claims are for 2003 so i don't have much to lose by waiting longer (although it does seem to be going on forever....much like this post;-) ) so any answers to my questions would be most welcome....Thank you0 -
Id like to ask a question.
Firstly ive been trying to claim charges from Barclays. In the end it went to court. I went to he first hearing, which i attended and it was decided the banks could apply for a 'Stay'. Then in December there was another hearing for the judge to grant a 'Stay' OR refuse a 'Stay. Now, i didnt go to the second hearing regarding the 'Stay' as i couldnt get time off work, and i knew the 'Stay' would be granted due to the OFT test case approaching. I rang the courts and informed them i couldnt attend and they said that was fine.
I read the other day that IF i dont attend a hearing even if its to grant a 'Stay' or not that the judge will strike out my case immediately? Will this have been the case!?
The first time i went to court i had to 'Sign in' by giving my name and bank name. Obviously this is to see who attended and who didnt.
Im now worried that my case would have been struck out.

I went thrugh my statements, few times my account was overdrawn (twice over arrange overdraft) once when I hadn't had agreed overdraft.
On statements it says: paid refferal fee £30.00
Is that what I can claim back, I know I had one more in 2006 but I don't keep my statements that long. My second question is is it worth to ask for statements from 2006 to claim that extra one fee?
Please don't get me wrong I just don't want to look stupid when my bank will receive the letter with my demands.
One quick question: where should I post it? My bank account was set up in Plymouth (Devon), but now I live in Kent.

harieta, you can claim back these fees and any other fees for bounced cheques or stopped direct debits etc...basically any charges EXCEPT interest charged for being in or over your limit and payment protection fees. (all these fees should be £20-£35...anything less and you probably can not claim it.)
Ask for 6 years of statements under the Data Protection Act which will cost max of £10 if anything at all..a template letter is on this link http://www.moneysavingexpert.com/reclaim/bank-charges#step2
If you don't ask in this way you'll probably get charged a fee per page which could work out to be quite expensive and you might find some more charges you forgot/didn't know about in those 6 years.

I suggest sending them recorded delivery to stop them saying in the future that they never received them. (Costs £1) You will probably get a letter back saying your claim has been filed and is on hold till the test case is decided. check back on this site when case is over for more advice on how to contine your claim. Your manager is correct in that it will be a different department that is handling claims and the interest will continue to be added to your overdraft.
Barclays have now replied to our letter telling us they will not give us the £275 as part payment and we will lose the offer - they then extended the period for another few weeks.
I'm at my wits end with this.

Hi everyone
Just received the post, a letter from Barclays saying will cost us and them lots of money if we pursue the claim to trial. They are therefore offering to pay £3720, (includes £120 court fee) The actual amount claimed is £9694.
It is 'without prejudice'. It does say The total amount of your charges is £3660. This is clearly wrong, possibly mixed us up with other claimants? Or only partial pay out?
Anyone else received similar offer?

Hi,
Lloyds TSB are infamous for offering 'without prejudice' part payments (£750 normally) and, as I recall, the general recommendation is that you reply to them, accepting 'without prejudice' the amount offered as a first instalment of the total amount claimed but making it clear that you intend continue your claim for the balance, unless full payment of the balance is recieved within a certain period of time. Or words to that affect.
Someone more expert will no doubt confirm or dispute my recollection in due course, so hang fire for now.0 -
Can n e 1 tell me if there is anything that i should be doing while im waiting? What i mean is.........i havent actually been to the courts regarding my claim, so should i be doing this or is the fact that ive put a claim in to the bank sufficiant? if i should be contacting the courts could someone please tell me so i can get this done. Is it the right time to look into claiming bank charges through Barclays? I dont know what the situation is with that case that went to court!?
