  • Just a quick question:

    I was going through the process to reclaim my barclays charges..... got to stage of asking for my money back around the time the test case broke. Recieved a letter from them that they are "AWAITING THE OUTCOME OF THE TEST CASE......YOUR CLAIM IS ON FILE" etc, etc...... and have not heard anything since.

    a) Should i have?

    and

    b) if so, what should i do next?....

    or is it c)......Just wait for the stalling b'stards?

  • :mad: ARRRGGGHHH!! This is really P*!#ing me off now, those arrogant idiots that barclays call their legal team have informed me via letter that on 24.9.2007 they put in an application to stay my case! that's nice of them.:mad:
    On checking with the county court they state that the judge is only in warwick twice a week to hear all cases in this and other legal areas? obviously the judicial system is on part time then??

    Can anyone tell me the following :-

    A) what will happen next

    B) what will i need to provide to the court in attempting to lift this stay (if granted) as it is causing major financial probems.

    C) any other ideas??

    Hi,

    Just to explain the situation:
    My Barclays account is now £650 overdrawn, all but £30 is due to their charges.
    My alliance and leicester account is £250 overdrawn, only £30 of that is actually my money, the rest is all charges added on by A&L due to them charging me the paid referral fee and then also charging me £50-£100 per month as charges for being overdrawn. Now, my point here is that I if it wasn't for their original charges, I wouldn't still be being charged now as I would have been able to sort out.

    Now, it also seems to me that the £50 per month can only be described as a penalty rather than covering their own costs.

    Now my problem is that I recently received a letter from Barclays saying that if I went ahead with my claim in court, it wouldn't go through as the OFT is currently in the middle of a ruling to decide bank charges which could take up to 12 months. Is it true that I can't make any claims until they have made that ruling?

  • take no notice of them....if you want to issue a claim through the county court then do so, chances are the court themselves may stay your claim, but at least it is in the system, do it now as the fees for court are changing on 1st October 2007...there is a court date set for January with the oft and the banks, however if your charges go back as far as 27th sept 2001 then its wise to issue immediately or you will become time barred under the Limitation Act.
  • I started a thread on the Reclaiming Bank Charges thread but didn't receive any replies so i'm wondering if i posted it in the correct place.. so i thought i'd better ask here instead!


    Back in May i got my bank charges fully refunded but then incurred a new seperate lot to which i asked for a refund again, and received this letter...

    I then looked at this wonderful forum again and saw that because i am in receipt of benefits they were not supposed to take any charges from it, i was advised by the good people on this forum that i should write a letter and someone helped me with a template stating the security administration act 1992, i then promptly sent it off, and today i received this reply..

    I don't understand it entirely, i understand that they will be dealing with complaint seperately to the other complaint where i received a refund of charges, but i don't really understand what they're actually saying they're going to do, i'm getting a bit worried thinking they may shut down my account (i don't have another!) It's the bit that says 'Once your circumstances have been fully investigated by the bank, there are a number of measures that can be taken in order to resolve this complaint including reviewing your financial position.' that is bothering me the most, i just feel like it's a slight threat, but i can't be totally sure so i thought i'd ask those in the know here what they make of the letter.

    here's the problem:
    I was in the process of trying to reclaim my charges and Barlcays told me that the OFT is currently making a ruling about bank charges meaning that everything will be frozen until that ruling has been taken place and no small claims court decisions will be made. They also said that this will take up to 12 months.

    My question is:
    Is this true?

    You say about County court but can't I just go through the small claims court, or are they both the same thing?

  • County Court and small claims are the same thing. All banks are sending out a standard letter regarding the test case, its then up to you if you wish to proceed with court action, please read Martin's Emergency Guide regarding this...
