    Hi
    Did MCOL, defence filed and now transferred to Reading (local CC), this was after the stay. I received a letter from Barclays (standard) 7th August, saying that they were applying to the courts for it to be put on hold and that my complaint had been registered etc etc

    Today I have received 'notice of allocation to the small claims track (hearing)'. Can I assume that their application was not successful and therefore we carry on as usual, OR do the banks apply once the notice has been issued?

    By the way it gives a court of 14th November (10 minutes!)

    I received my statements from Barclays on the 39th day, using the calculater to work out interest I sent a claim in for £2070 + interest giving a total of £2597.24 I have received a letter saying that although they disagree with my claim that without any admissions of liability they are willing to offer me £1500. towards the total amount I am seeking, this is with the cost & inconvenience inherent in a further dispute in mind and is intended as a gesture of goodwill, in full & final settlement of my complaint. They then go on to say if I want to accept their offer to send the form back & the money will be in my account in 10 days. They say if I am disatified with their proposal for resolving my complaint I may ultimately be eligible to refer my complaint to the FOS.

    I sent them this letter on the 26th June

    Thank you for your letter dated 08 June 2007 for an offer of £1500.000 in full and final settlement to my claim.

    I am not willing to accept this as full and final payment. I will be happy to accept this offer as 'part payment' to my claim of £2597.24 , without prejudice and I shall be persuing the claim by means of the Financial Ombudsman for the remainder of the money owed to me.

    However, if you are prepared to pay to me £ 2000.00 within 14 days of the date of this letter, I am prepared to accept this lower figure in full and final settlement of my claim and interest.I look forward for a full response to this letter within 14 days.

    They've not even acknowledged it & they didn't even pay in the £1500.00 they originally offered , advice on what to do next please :mad:

    Unfortunately my claim for just over 3 grand from Barclays went through MCOL the day before the great we're in bed with the FOS came out. This being the case it is now held and I have had a letter from Barclays saying that because of the outstanding test case I will get nothing until it has been resolved.
    The cheeky swines have since passed over my other account which has £600 outstanding to their collections arm and they are threatening to come round my house and get it.
    I really feel like saying that because of the test case they will have to wait or telling them to bring a ball when they come as I will have the baseball bat ready.
    Joking aside is there anyway I can use the outstanding charges claim against their request for the £600.

    chipbeck if you can prove hardship then you may well be able to get the stay lifted.

    don't despair, all is not lost. The bank has sent you this letter re the test case hoping that you will give up. However the banks or the OFT have no authority over the courts. Continue to pursue your case oline with MCOL - how far have you got so far?

    Well I'm up in court in a couple of hours and I'm really really nervous.

    I have notes and everything on what I want to say, but I feel I'm going to clam up when I actually have to stand up.
    Getting there... A deal at a time. :T

    It just says 'HELD' on MCOL.

    I rang MCOL who told me that the case had been assigned to Preston. Rang Preston who said the case is up in front of a judge today. Told the guy that Barclays have already written to me telling me not to bother as they are having all cases stayed. He said they had not been contacted by Barclays so it was up to the judge. Should find out in a few days whats gone on as they will write to me from Preston.
  • hi got a letter from court telling me that my case has been stayed, this without considering representations from both parties, i have seven days to appeal,but as i have been away for a couple of days this date has passed.(received letter 4DAYS after it was issued) i sent to court a few things to put on my file ,one of which was a letter opposing a stay , obviously the judge couldnt be bothered to look at these documents where do i go from here , ....do i have to accept this stay ??????....iam totlly peed off with this judges decision,after months of hard work, ,he cant even be bothered to hear my case.....AAAARRRHHHHH.
