I've been going through the whole reclaiming since february.
it got to the stage where i presented the judge with all my charges,type date etc.
barclays submitted there usual defence.
then the judge ordered that the defendant complies with paragraph 2 of the order of the 13th of june by 21st of August or the defence be struck out and the claimant would be entitled to enter judgement for the amount claimed!
now they havent complied with this!
the deadline being today.
so i'm stuck!
I know all about the recent stays on bank charges but i didnt recieve a letter saying my case was being stayed!
but they havent replied so what shall I do now?
what can i do to be more precise?

Barclays offered the full amount I was going to claim through the courts. A recorded delivery letter arrived 2 days before court (and before cases were put on hold) with the offer, if I did not go to court.
I accepted, signed the letter, and am still waiting, well over 21 working days later, for the cheque to arrive.
Phone call after phone call has had no effect, they are hiding behind the courts putting cases on hold or 'we cant find the signed agreement letter (I still have a copy of this).
The court office and ombudsman have offered no constructive advice.
Do I go back to court? If I can send in the Baliffs how would I do that?
Any sane advice for one who is loosing it?0 -

I think you should ring your local Citizens Advise and ask about whether or not you can use baliffs without a court judgement (i'm quite sure you can, though you may have to pay them yourself and then take barclays to court to get that money back)...find out from your local C.A about baliffs and then, if you can use baliffs, write barclays a letter saying how you want the money in 7 day's or else baliffs will be going into your local branch on the 8th day and you'll want more money to pay for them, plus any other costs you incur whilst trying to retrive this money...if you do have to go to court for the baliffs to act, i've read somewhere its quite a quick process...good luck0 -

This really does prove the point that court action should not be withdrawn until the refund is cleared into your account.
The only advice I can give is to re-issue your claim if you have no joy contacting them. Have you tried emailing the bank. Which number have you used as I have one from my first barclays settlement which may be different to the one you are trying. PM me if you want it.

I got one of those too, ordered by Judge Cooke of Birmingham CC. Remember him? He was the chap who gave the banks their first victory against Mr. Berwick. Not happy.0 -

Just got a letter from Northampton County Court (despite living in Reading and filing a claim against Poole branch). Barclays have filed a defence against my claim and without hearing it is ordered that the claim shall be stayed pending judgement in the test case.
