As MCOL are automatically staying all cases that are defended by the bank its better to file your claim at your local court and then it is up to the individual judge as to if the case will be stayed or not.0 -

Hi Edinburghlass, my case has not been stayed by MCOL. A judge in Preston looked at it on Monday. I rang them on Tuesday but they said the details will be posted to me. I fully expect a stay as that is what is happening in Blackpool and they probably have the same circuit judge.0 -
Have you all sent/taken your applications to uplift the stay? and your objection letters and letters to your MPs, Master of Rolls, FSA, MEPs ???

Don't know if I can be bothered going down the hardship route, to be honest I'm fed up with the whole affair. At the end of the day the banks can do what the bloody hell they want to so what's the point?0 -
I sent them this letter on the 26th June
Thank you for your letter dated 08 June 2007 for an offer of £1500.000 in full and final settlement to my claim.
I am not willing to accept this as full and final payment. I will be happy to accept this offer as 'part payment' to my claim of £2597.24 , without prejudice and I shall be persuing the claim by means of the Financial Ombudsman for the remainder of the money owed to me.
However, if you are prepared to pay to me £ 2000.00 within 14 days of the date of this letter, I am prepared to accept this lower figure in full and final settlement of my claim and interest.I look forward for a full response to this letter within 14 days.
They've not even acknowledged it & they didn't even pay in the £1500.00 they originally offered , advice on what to do next please :mad:0 -
I was in Court this morning for a preliminary hearing at which my case, and that of three other people, was stayed.
However I felt that the judge was sympathetic to our cause. He deliberated for some time over his decision and finally stayed the case on the condition that no further charges were made on our accounts.
I feel that this was some small victory although I hope Barclays do not decide to withdraw our overdraft facilities altogether.
Cases are certainly not being stayed automatically and I do not feel that the banks are able to throw their wight around quite as much as they would like.0 -

I am in the same position. The judge at Wigan did the same to me on Wednesday.
I also fall in the hardship bracket but i don't know what to do.
The judge told me anyone haveing a case stayed would fall into hardship and advised me not to apeal as he was only following instruction from the curcuit Judge.
I don't know who to approach with reguards to getting the stay liffted as it was put in place by the court not the bank.
My claim would have paid of all the debts created by the charges.

i have sent my first letter to barclays asking for just over 1200 inc intrest. they sent me a letter saying that all cases had been stayed.
i am currently unemployed so do you think if i apply to the courts i would get the stay lifted due to hardship:confused: If i didnt have any bad luck id have no luck at all!!£2 Savers Club - £22£365 in 365 days - 21/3650 -
You can't apply to the court to have a stay lifted as you actually haven't got that far yet, this is a standard letter from the bank.
You can go back to the bank and ask them to deal with your case as a hardship case and if they refuse you can refer to the FO, have a read of Martin's Emergency Guide here...
