Hi guys....I swear I have been looking for a Barclays thread for ages and I could never see it. Now when I do it's like 124 pages long???!!!!!
Anyway just been on the phone to Southend Court where myself and my partners claims have been transferred to.
The Bad news is that the Judge there has already decided to stay all cases until after the test case. The bank did not even have to ask for a stay it was just given to tham on a platter of gold:mad:
we were made offers ages ago...does anyone think these still stand?0 -
Still no statments or even a reply to my letter asking for themFriends are angels who lift us to our feet when our wings have trouble remembering how to fly.0

Hi ok, im dealing with bith my mums claim and mine, my mum has just had a letter from barclays (she's about a week in front of me) it goes
"May i say how sorry i am to learn that you feel the bank charges you have incurred are unfair, in your correspondance you have referred to elements which you feel support your claim, Barclays is aware of the information you have drawn to our attention i must inform you, however, that we disagree with your view. when an account is opened with us ourt customer is provided with a copy of the terms and conditions relating to the use of their account including details of our charges. this information is clearly explains our obligation to our customers and theirs to ours. (ect ect)
In view if my comments above I am unwilling to refund you the charges you have incurred as requested.
it then goes onto to say if we are dissatisfied with this response we can go to the FO and if they haven't heard within 8 weeks they assume this matter is concluded"
Now to me they obviously know we cant go to the FO now and as my mum is a pensioner she cannot afford to take the court route, so i was gonna draft a letter to barclays along the lines of;
Dear Barclays
With regards to account number xxxxxxxxx and as requested responding to your letter dated 24 july 2007 within the 8 week deadline stated by you. Whilst we do not agree with your decision that the charges are fair, knowing that they do not reflect the true cost to Barclays and knowing that the financial ombudsman at present is unable to take more cases on due to the test case in the high court we are writing to notify you of our intent to await the decision of the office of fair trading and the court before we pursue this matter with you. Once a decision has been made we will contact you again.
How does that sound?? any ideas wld be great !!
kind regards

I am at the stage with MCOL where Barclays defended on the 28th day. I have received the defence today and also a form saying that they are no longer requiring the Allocation Questionnaire but I still have to pay the fee.
Does anyone know when I have to do this?
Also whats my next move, or do I now have to wait to hear from my local court re a date.
Thanks in advance for any help0 -
You need to pay the fee if your claim is over £1500 and there should be a timescale in the letter giving you a date for this,0

Hi
I received a written offer from Barclays a little while back, I decided there and then that i wouldn't accept it and would go through the court process to recover the full amount.
Now I have recived a letter from the court requesting I make an allocation Fee of £100.
As there is a chance that my court date court could be stayed for up to a year i'm very tempted to accept Barclays offer.
I would like to know is the offer likely to still be valid even though when I called the bank they said they have put a hold on all claims until the OFT case goes through?
I need to make my mind up quickly as if I continue with the court action I need to get a cheque in the post tonight for the Allocation Fee.
Thanks for any help
