  • You can send it to either local branch or head office. Also send it special/recorded delivery and dont loose your slip and back up all letters sent and recievd from the bank as you may need them further in to your claim. If you go to court or the cheeper version is the financial ombudsman which is free but you have to wait so many weeks before you can take your claim to them or you recieve a letter from the bank saying you are not entitled to the money as the charges are fair and the case is closed . That way you can go to the ombudsman with your complaint

    bit of advice required really.

i have had my statements through from barclays and i have been through and got about £700 worth of bank charges that i wish to claim back.

im also currently overdrawn by more than this figure (£1200) as still recovering from student days, but if my wage this month (£1000 or so) and a settlement for my charges went in i would just about be out of my overdraft.

what im worried about is they will close my overdraft if i do this claim, or even worse close my account and leave me without any money for the month.

    what do people think?

I started my claims for both my sons before Christmas and we are still waiting for a payout. Have been offered partial reimbursement which we refused. We now have a court date for 15th August - am beginning to get worried. Why are there so few postings for Barclays ? !!¬

B is probably the same as others -inconsistent in their appraoches My daughter recliamed nearly £2000 Used Martin's templates.Did not start court or ombudsman and waited the 8 weeks for a reply for her claim they paid up -no fuss on 6th week
I have an email from someone want iinfo/contact with others as Barclays has got a barrister to defend 40 cases wanting a precedent.

Could someone please help me? I sent barclays a Data Protection Act 1998
Subject Access Request with a £10 cheque.

Just recieved a letter from them basically saying that

"please be aware that the bank is not under an obligation to present information according to any particular format. Therefore your request to assemble a schedule of charges is turned aside.

They go on to say we'll give you a copy of your bank statemetns for free but

"Some statement information from the period prior to and possible during 1999 to 2000 is manually stored in the form of microfiche and does not fall within the data subject access provisions of the DPA"

"also states the DPA does not oblige the bank to comment about internal policies and procedures"

"Whilst aggregated information is retained for statistical purposes, this would not constitute "personal data" under the DPA and therefore would not be covered by a s.7 DPA subject access request"

Someone please help me and tell me what on earth they are saying in laymans terms and what my next step should be?

Should i wait for my statements and then calculate and send the schedule of charges and second letter requesting they pay my the monies owed??

Yes- you have to get all your info and then calculate. This happened with one of mine -just different wording -basically they will send statements from a certain date and a letter to say that you will have to wait longer for Microfiche - just an older recording system . I had to wait quite a long time for this. When it comes it is not quite as easy as reading the statements re charges as there is a lot of other stuff and coded. They do give you an index of codes etc Just takes a little longer but it is not rocket science and you can do it ok.

I sent off the 1st letter to Barclays asking for £1404 to be refunded for bank charges and got a letter offering me £850 in full and final settlement of my complaint. Can I accept that 'without prejudice' and go on claiming the balance? Has anyone done that?
I've also just discovered that I have been charged another £30 for going over my overdraft limit. Can I add that to the sum I'm claiming, ot must I take out a new claim?
Any thoughts on these issues will be very welcome.

Only you can make the decision to accept, all i can do is tell you what will happen next.

    1. If you accept the offer then you will have the money within a day or two.
    2. If you accept "without prejudice" they will withdraw the offer and let you take them to court. once you start the court papers rolling then you can claim the interest as well. Even more money.

Also any other charges... just add them on; they all count

    Good luck:cool:

  • Hi there

Im in the same boat - Ive had and ignored an offer of 600ish of a claim of 1000ish from barclays and in the time since i started the claim been charged 4 x 30 unauthorised borrowing fees - im currently at the 'acknowledged' stage...and they have about a week left before the 28day deadline....my questions today are..

    1) did i do anything wrong in ignoring the offer letter or should i had at least acknowledged i recived it and told them i didnt accept it?

    2) when i sent my final letter to them i didnt include the actual statementswith charges highlighted - i sent a break down of the charges, dates and interest with a total (copy/pasted) from the calculator - would that be a problem?

    3) with now less than a week before the 28day deadline should i phone anyone to try and jostle on a settlement?

    4) what should i do re the new charges i havent asked hem for yet?

    thanks all

    james
  • Barclays paid just short of £5000 into my account on Wednesday. The news yesterday was a surprise and I am so releived it happened before the test case story broke.

I followed the advice on the site to the letter and the bank paid the full amount after a initial lower offer that I knocked back.

The threads and website were a godsend. Thanks very much. ;)
