    What was the test case story? It sounds rather ominous! Thank you for your replies to my post, I'm about to send the letter accepting 'without prejudice' and going on to claim the full amount, but maybe this test case result is not good news?

  • I did sign my acceptance letter for the bank to accept their 'gesture of goodwill', before I received my statements from them. I then cancelled it in writing saying that I want my full bank charges, but they ignored it and put the 'gesture of goodwill' amount in my account. When I rang the bank up and questioned why they did this, they said that because I signed it in the first place, they put the money in my account and that I could not cancel it. I wrote the cancellation letter because I now know the total of all my charges and I want to claim it all back. (When they made me that offer, they didnt even send me my statements, when I asked for them - crafty!)

    Does anyone know, if I have the right to cancel? Surely I must have.

    Please let me know ASAP if there is anything I can do about it.

    OK so now I have had an offer, just under 50%. (Bl. cheek)

    With the present test case senario, if I accept without prejudice and tell them I want the full amount.

    Will they withhold the offer

    Now an offer has been made can they now refuse to honour the offer.

    Your signature basically says you accept everything on the paper it's on, on the acceptance form it basically means you are happy with the offer, once they've payed you their part is finished.

    OK slightly off topic but I'm upset.
    Claim was defended yesterday by Barclays so they'll probably put me off for another year. Was wondering if they could combine their two current TV adds. The one where the young lad puts a golf ball through the PLASMA telly in the office and the one where the young lad mentions an idea to the boss while he is swimming in his OWN pool.
    I'm sure I could make a decent X rated commercial by combining the boss the telly and the pool if you get my drift.:rotfl: :rotfl: :rotfl:

    If they gave you an incorrect amount for the total of all your charges when you asked for the details (at the start of the claim process), then that's a no no and you may be able to make a fuss about that.

    OK thats it!! no more money from Barclays
    I have been at this since Feb, turned down partial offers and took it all the way to court. Now 30 days before court Barclays tell me they will be asking the court to hold out my case until after the test case,
    Brilliant just brilliant - so all this time and effort and probably for nothing - Consumers don't win against big rich banks so its all over!!
    Barclays - Reclaiming - £3380 - stayed 30/08/07 - £2261 goodwill 20/02/09
    Abbey - Reclaiming £250 - 1st letter - stayed
    MBNA - Reclaiming £400 - received £294
    Morgan Stanley - Reclaiming £138 - received £120
    MINT - reclaiming £110 - received £90
    A&L - £170 charges - £170 back!

    Been to court this morning. Barclays didn't bother to turn up . The judge asked me a few questions about why I have brought a case against Barclays and told him that the amounts they have charged me were illegal and he agreed. He asked how much I was after and I told him £1650, including interest and court charges. Cheekily, I also told him I would like to be reimbursed for having a day off of work, he agreed but said the maximum he could give was £50, so I accepted this gratefully!! Also tried to claim for the hours I had put in preparing for the case but he said that I was not entitled to that, but if I had employed a solicitor then that would be a different story.Thats why all the solicitors are trying to jump on the bandwagon. Good luck everyone- don't let the !!!!!!!s grind you down!!
    Should be getting £1700 from Barclays in the next fourteen days or I am to take out an enforcment.Hee Hee
