    i originally asked for judgement by default and wanted the courts to enforce immediate payment, that got rejected as i suspect they are putting in a defence??:mad:
    That's what's happened to me, they are defending all my claim ( 28 days are up next Thursday). I did get a call back today from a Dino (the litigation department at Barclays). He told me who was dealing with my claim and I took his number but was told that it's not worth calling him for a settlement as they are only dealing with anyone that has a hearing date. I was then told that if I did want to settle, that it goes on merit but that they are defending all my claim.
    So fed up with all the messing, not sure what to do now.

    I sent off for copies of my husbands bank statements from Barclays using the letter templates off this site. I enclosed a cheque for £10 from our joint account. Yesterday my husband received copies of our joint account statements (with the cheque returned as Barclays offer this service for free.) Problem is they sent statements for wrong account. Our joint account has only been open 18 months and has never had any charges and I have all the statements it was husbands account that we asked for. I've checked my copy of the letter that we sent incase I had put the wrong account number on but it is their mistake not ours:mad: What do I do now? Do I just send the first letter again and wait another 40 days or can I send them something pointing out their mistake and ask for the statements sooner.

    If I were you I'd ring up Barclays Customer Relations on 08456090806, you can register with them that you wish to claim the charges back there and then and request your statements. Good Luck

    I'm trying to reclaim my bank charges from barclays bank since april with letters going back and forth now the latest letter i've received is saying we (barclays) they are willing to pay half of the amount(£1500) but that this will be deducted of £900 overdraft which they will take to settle that debt , my problem here is that i'm already making payments towards this debt with a finnance company that was set up by the citizens advise, can barclays do this if i have already made an agreement with a finnance company who i think have nothing to do with barclays, the overall amount is £2000 plus £700 interest, also the amount of £2000 was confirmed to me while dealing with the reclaims dept and he said to me that he cant understand why they havent paid out this amount, i have phoned this morning to say that im not happy with this and in have been informed that this is the final offer so could anyone please advise me of what course i should take now

    I would accept the offer as part-payment on the basis that you will continue action for the full amount. You will need to carefully word any correspondence and can get wording from this site. If you check Martin's advice on the home page I believe it has a template there.

    In terms of the overdraft, yes they are allowed to clear that first before refunding any difference, it makes no difference if your with a debt counselling service. From experience they will pay the refund in to your account and you will possibly have to request the account to be closed and the refund to be made to you.

    I rang their customer relations office again today in the hope they would be willing to give me a better offer in light that i have gone through MCOL. i pointed out to the person on the phone that total charges & interest comes to nearly £4500.00! i said that my offer of £3500.00 was still available if Barclays was prepared to negotiate, i was told that initially when all this started they did come to better offers but policy on this has changed and the full and final offers is all they would allow.
    he did go on to say that i had the option of court or the financial services ombudsman, i told him that i have a case against the bank via MCOL and unfortunately as they are not prepared to come to a better offer (£2235.00) i would be terminating the call for now.:(

    i then recieved this email today:-

    I can confirm an acknowledgement of service was filed on 12<SUP>th</SUP> July 2007.The defendant therefore now has 28 days form the date of service (30<SUP>th</SUP> June 2007) in which to file a defence.

    Hi everyone.

    I've just begun the process of reclaiming so this is the first time I've posted on this forum. I just wanted to say that for people who are having problems getting statements it is worth requesting them through telephone banking 08457 555555. I and my partner called separately last week and have received statements on three accounts today- no problems with royal mail!

    When we called we mentioned that it was in relation to reclaiming and took the name and call centre location of the person we spoke to so there was a record of the request.

    Slight inconsistency. They charged my partner £5 but I got mine for free, despite being told they would charge. They debited the money straight from his account.

    That was the easy bit- now to claim the money- looks like it will be thousands. Scary!!

    not sure who the guy was at Barclays but it was their customer relations department that governs all complaints especially bank charges!
  • Hi Barclays have defended my claim for £1700.00 and I am waiting for my AQ and court date. I rang Barclays customer relations (hoping to get a settlement) they were very polite but not very helpful really, no refund or settlement has been offered.............I was eventually transferred to litagtion and spoke to a really nice, helpful guy, I was told that they are dealing with cases in chronilogical order, (by court dates). Once I have my court date I am going to call back and ask for a settlement - I hope it's soon as Barclays are changing their procedures regularaly. I don't want to go to court!!!!!!!Anyone else at the same stage?
