    As the initial 14 day period from when the claim was posted expired on 14.7.2007, i tried to file a judgement by default on and after that date but it refused to do that. this morning i find out the bank issued an acknowlegement of service and had 28 days to file a defence!?:confused:

    now having been back on MCOL i have managed to file a judgement by default against them which has been accepted! Erm what happens now?
    i have indicated that i require the amount in full immediately.... any ideas?:confused:

    They get 5 extra days to allow for post and admin to catch up! so 16 becomes 21 and 28 becomes 33 :(

    If you're judgement by default holds (mine got knocked off because the got a reply to the court on the same day) then you have won! Go back on MCOL and on the same line you will have a new Start option - click it and tell the court to get your money for you ASAP ;)

    Hi can anyone help please
    BARCLAYS -I Received a letter today from court,notice that acknowledgement of service has been filed.
    The defendant filed an acknowledgement of service on 11th July to which Barclays are indicating intention to defend all of the claim.
    Then goes to say that the defendant has 28 days from the date service of the claim.
    I need help with the dates if anyone can help please. Does it mean from the 11th July or from when they got issued which was 21st June?
    Also i'm very nervous to what I should be doing next and i'm lost in all of this and if anyone could be kind enough to help me please.

    What happened after yours was knocked back?

    Same happened to me today, after a late acknowledgement.

    Hi All,

    I've been reading through this thread with interest having received a court date for a directions hearing in august.

    Following several peoples advice I called 0207 116 1943 hoping to speak to the litigation dept and fingers crossed to get a settlement.

    It appears that this number is NOT being answered.

    I then tried 0207 116 4753 (krysta) - this goes to voice mail and informs you that she can only speak to people that she is dealing with.

    Any other numbers? Or should I just concentrate on my court pack?

    It means 28 days from the date they received the claim so 28 days from the 21st June. You dont need to do anything at this point but wait and see if they do actually defend. They have until 26th July by my calculations (including date of service) to actually defend and may offer a settlement anytime now.

    Its a known delaying tactic to state an intention to defend to simply drag out the extra time intimidating you and hoping you will give up. Try not to worry, sit tight and good luck :)
  • Hi, I would appreciate advice on my claim against Barclays (formerly Woolwich a/c).

    I am at stage where Barclays Lit. Dept have transferred to my local court. They have sent me a preliminary hearing date on 30th July. Unfortunately I am away on that date, so went to the court to ask advice. They said I have to get written permission from Barclays to change date, I sent letter (recorded del) enclosing both acceptance letter and SAE for them to return in 7 days - which of course they haven't done. This means I have to go and file an Application Notice to change the date and it is going to cost me £65.00 :mad: :mad:

    Help! Do I:-
    1. Go to court today and change date, it will have to be before the 30th July apparently, and pay further £65.00
    2. Just leave the whole thing, hoping Barclays will not proceed.
    3. Phone Barclays - what number?
    4. If date is changed to next week, what do I take to court preliminary hearing with me?

    Time is running out and I would appreciate some help from you guys on forum.

  • Hi - I put in a claim for £1300 plus interest in May. I have given Barclays a lot of leeway, even letting them fob me off with their 'we are looking into your complaint' letter. I finally got an offer from them at the end of June - a refund of 70% of my charges (and only 60% of the amount I claimed). WHat nice clean figures!!!! I rejected this and gave them 14 days to make a better offer before I took further action.

    They deadlocked me - they won't budge on their original offer which is not good enough.

    So I have gone to the FOS today. I will let you know the outcome but I am looking for an offer that refunds my charges plus interest plus costs now!!:mad:

    Hi there and HELP!
    Have copied and sent your suggested claiming letters and have worked on both HSBC and Barclays - eventually!
    From Barclays I was claiming £2038.92 (including interest)and they have just offered £1316.00 - have contacted numerous occasions :mad: but have got nowhere. Do I accept offer and be grateful or do I go further, and if I do how long may this process take?
    HSBC have offered me £450 - claimed £599.64 (inculding interest) - same questions for this.
