    :mad: :mad: Just typical i thought that not seeing anything indicated on MCOL after 14 days i had basically won my claim! i feel now this is not the case as i recieved a letter today from the courts to say that an defence was given on 12.7.2007!!:mad: :mad:

    I can't wait 28 days for a court to decide if they will or will not force the bank to pay up! i am at a loss now in deciding what to do as that money even 75%of it would have sorted a large problem out!

    I think that you can be fairly sure that you will get paid out, its just the timing thats an issue.

    Just out of interest, did you request a "judgment by default" after the 28 day period?

    On the 22nd June 07 i sent a letter to Barclays requesting they pay me the £1900 they owe me in unlawful charges. I also mentioned i was very unhappy it took then 65 days to send me my 6 year histrory so i want a responce wihin 14 days of this letter. On the 30th of June i received a letter telling me theyre looking into my complaint but they cannot guarantee thay can turn things around quickl, so they gave me a time scale of finding a solution within 4 weeks! BUT if they are unable to do this they will write to me informing me of any progress and it could take 8 weeks!!!:mad:
    I have waited 2 weeks and decided to phone them as this website advises me to not allow the bank to dictate;) . I explained that i wasn't happy waiting any longer as they took so long before and i wanted a reponse within 7 days. The lady reponded by telling me there is a backlog and you may not get anything before the dates stated on the letter. She also said we apart of the Financial Authorites Act and you're welcome to take it to court. Believe me i want to take this further but i would like some advice from anyone who can help me at this stage. Please assist me in my next move

    I am just about to send my letter requesting return of bank charges off to Barclays Bank. But I am not sure of where to send it to. Is it to my account holding branch? Or to another main department??? Help! :eek:

    I'm (like many others) struggling to speak to Barclays litigation team, due to busy lines.

    Has anybody had recent success in making contact? if so, what are the successful contact numbers/names?

    Read through this Barclays forum you will find numbers for the litigation department.

    Now you have a court date they should settle over the phone.

    As the initial 14 day period from when the claim was posted expired on 14.7.2007, i tried to file a judgement by default on and after that date but it refused to do that. this morning i find out the bank issued an acknowlegement of service and had 28 days to file a defence!?:confused:

    now having been back on MCOL i have managed to file a judgement by default against them which has been accepted! Erm what happens now?
    i have indicated that i require the amount in full immediately.... any ideas?:confused:

    Today i got home from work to find a letter from Barclays offering me £770 of the £1030 without interest (£1384 with interest).

    I initally sent my 1st letter on the 11th May and then sent my 1st letter threatening court action 6th June. I got a letter back giving the excuse of could take upto 8weeks but they would be in touch by the 17th July, and they were!!! :beer: :j:j

    Now the thing is has anyone rang Barclays when they have received their offer and tried to barter a bit more out of them? How did you get on?
    If they refuse can i still send the slip back accepting the sum of £770 in full and final settlement?

    I may be just being greedy, but hey they've had my money for over 5years i want as much of it back as possible! :T

    Dont bother to post your letters. Just do as i did and HAND deliver them to your local branch. That way you know they have your letters.

    Just walk in and hand it to someone saying "Can i just leave this with you please" if they ask what it is just say.. "if you open it you will find out." and walk away. DONT get into conversation about it, just walk away.

    It worked for me and i got nearly £4000 back in April, plus £1000's for other people.

    By the way..... in doing this you will walk out of that bank with the biggest fattest grin on your face ever... trust me.:rotfl:

    Phone them first thing in the morning and tell them that you have sent your court papers off to the local conty court allready on monday and you are claiming the interest. If they say ok just go ahead with the court claim then you can say "well make me a better offer and i will stop the court claim"
    i think you will be pleasantly surprised when they change thier mind.

    If all else fails (which i doubt) then take the £770.

    I accept the amount of _____ as part payment and without prejudice to my full claim that I shall still be pursuing through the small claims track in the county court.

    Might I also remind you that when I win in court you will be ordered to repay my claim in full, including interest @ 8%, my court fees totalling _____, and in recompense for my time and effort for bringing this case against you, a Self Litigation Fee of an estimated £230.
