  • I just thought I would see if I'm worrying over nothing. I wrote my first letter requesting my charges and interest back to Barclays on 18th May. They have written to me twice and said they are still looking at my request and that I woud get a reply by today. STILL NO REPLY!!! I have just wrote another letter saying I will take court action but after looking at some of your experiances Barclays seem to be one of the worst for paying up.
    Just wondering what will happen if I get no responce again, and how far you have to take it???

    If you are taking it to the Financial Ombudsman then you have to play by their rules. But if you take it to court they have to play by yours and pay you interest too ;)

    Its based on claim value - if you add interest it will take your claim to over £1,000 which would cost £120 but you would get this back off Barclays and its worth doing ;) Other wise your fee would have been £80.

    Fees are as follows
    Upto £300 claim =£30 court fee
    Upto £500 = £50
    Upto £1,000 = £80
    Upto £5,000 = £120
    Upto £15,000 = £250

    But as you claim benefits you can get the fee waved by going to your local court and doing it the old fashioned way (on paper) the form is the same, see Reclaim Bank Charges Help Thread last posting for the words and ask for the N1 Form as natweststaffmember has said along with a claim form :)

  • I was worried by the lack of positive results from Barclays, but they did pay out eventually. I sent the letter saying I would commence court action in 14 days and even sent a follow up seven days later just to let them know I was serious and got no reply. Then I started the court proceeding online and they only submitted their defence a couple of days before the date I could request a judgement by default.
    Hopefully they will pay up for you but if not be prepared to start the court proceedings and add on your costs to the claim. They even submitted a defence to my claim but the court bundles you need are easy to fill in with your details and would probably ensure they pay out.
    Less than a week before my court date they said they would pay up-although they still maintained I was wrong!

  • Hi everyone....I have my court date 20th august and am trying to gather the court bundle....i'm struggling...does anyone know where to get a copy of the woolwich terms and conditions....and if so what date should they be? are they meant to be the year you opened the account...if so its 2000.

    Please help!!

    Still haven't heard from them - yet on saturday they rang me to tell me i was £10 over drawn and could i pay some money in over the phone so i didn't incure more charges - !!!!!!? They have never done that before!

  • :mad: :mad: Just typical i thought that not seeing anything indicated on MCOL after 14 days i had basically won my claim! i feel now this is not the case as i recieved a letter today from the courts to say that an defence was given on 12.7.2007!!:mad: :mad:

    I can't wait 28 days for a court to decide if they will or will not force the bank to pay up! i am at a loss now in deciding what to do as that money even 75%of it would have sorted a large problem out!
