    I am trying to reclaim over £2000 from Barclays and have got to the point where I am awaiting my court date. Everyone I have spoken to at Barclays litigation department have been very helpful and have told me that they intend to settle when I get a date. However, this process has taken many months, so my husband, who is trying to claim £1,500 from Barclays has decided to take his claim to the financial ombudsman rather than the county court. Both processes seem to be very lengthy but I will use whicher process is the quickest and most effective when I get to this point with my claim on our joint account!!

  • Hi i have just recieved my statements from barclays and have totalled up £2145 to claim back in unfair charges. I am going to send this off recorded delivery i was just wondering do i send it to my branch or is there another address for barclays i am best sending it to? thanks

    You can send it to your branch I did, they forward them on to the relevant departments :)

    Firstly, don't worry this is just a Directions.
    If you are not going to be able to attend, you can send in a written response as there is unlikely to be another opening for some time and a postponement will mean it drags on for quite a few extra months.

    :rolleyes: What do I need to prepare for a directions hearing?

    First of all, check with the court correspondence and see if it has specifically asked for either party to submit anything by a certain date.
    If the answer is yes, post the Order details on here.
    If the answer is no, you should take the following:
    Bank statements & schedule of charges (in case they want to settle)
    Allocation hearing Witness Statement
    Draft order for directions &
    Reason's why they should be ordered
    Copy of this order - page 1 & page 2 (to demonstrate that other courts are already routinely ordering those directions in small claims cases)
    Statement of evidence (to refer to if necessary)
    *Copy of the text of the
    Lincoln 'abuse' order
    *List of settled cases

    *Optional - take if you want to show it to the judge and politely suggest that a similar order may be appropriate in your claim.

    The main purpose of these hearings is for the judge to make directions or other orders, narrow the issues, and otherwise decide how the claim is to proceed. The exact reason for a Prelim hearing should be stated at the top of the order.
    You won't need your full bundle for any of the above hearings - its not the 'final' hearing so you won't have to argue your case as such. However, it is a good idea to make sure you brush up your knowledge of the basis of your claim, in case any of the issues are discussed or the judge asks you any general questions. The judge could also attempt to get the parties to agree to a settlement at these types of hearings.

  • :confused: well 2 days ago i recieved a response from Barclays customer relations department, they offered me £2235.00 as a "good will gesture" and indicated it was a "full and final payment"...erm i don't think so!

    i called them yesterday and informed them (poilitely of course!) that i was rejecting their offer and i have taken this up with MCOL.

    with that they said tank you and hung up! iam i doing the right thing? after all they have hit me for nearly £4500.00!:confused:

  • my sone got a letter from Barclays this morning saying he'd been charged 30.00 for being 36p overdrawn can he claim this back - also was charged 35.00 for being a pound short last month for a standing order not paid - he has only had the account 4 months are they covered or can we claim ? thank you
  • Hi we are quite early on in reclaiming and have sent the statements to Barclays using the template letter which states that they have 14 days to respond. They have replied saying it will take a while to look into the claim. What do I do next is there a timeframe they have to stick to? Thanks
