    Send them the “Letter Before Action” letter.

    At this point, you have to decide between referring your claim to the Financial Ombudsman or starting court proceedings.

    If you don't think that you could successfully handle a court claim, or can't afford the court fees and aren't eligible for fee relief, then the Financial Ombudsman is an alternative. It is free of charge and handles everything for you. However, they cannot force the bank to pay up, set the level of the settlement or award interest like a court. Despite this, their success rate is good. Being financial experts, they can also threaten to ask the bank some very awkward questions. If the Financial Ombudsman is unsuccessful, you can still take the bank to court.

    If you threaten to refer your claim to the Financial Ombudsman, give them until 8 weeks from the date of your first letter to reply. However, if the reply either suggests that you now refer your claim to the Financial Ombudsman or says a definite no, then you can refer your claim to the Financial Ombudsman straight away. If you have not received any reply for the 8 weeks, then you can refer your claim to the Financial Ombudsman.

    If you threaten to start court proceedings, give them 14 days to reply. If you have not received an acceptable reply by this deadline, then start court proceedings on Money Claim Online.

    you need to threaten them with court, give them 14 days and take them to court, remember YOU set the time scale, by not following what you said you are not staying in control.
    for what its worth, court process is quite easy as long as you do it all properly in the first place.

    Well i requested my statements on 19th april never turned up i rang them 40 days laters advising sent recorded delivery they said they didnt have the request on their system then suddenly the set i requested after the 40 days turned up on my doorstep with the original set and cheque i had sent so i would say that they proberly hold them back and issue them by date which is a bit cheeky
  • I know Martin tells us not to get nervous, but my bank (Barclays) have just put in a defence to my claim. They did offer me a part-payment just after I filled in a claim on Money Line and I am wondering if I should have accepted it. Help....

    No, you shouldn't!

    Stick to your timetable, they owe you all your claiming.

    I'm sure you know, but Barclays only offer you a part payment to get one over on you. The defence is designed to worry - and it often works - but heres the but.....

    It is an attempt to convince you they are in control, and they are not.

    They are more worried than you might think, and are relying on that defence to make you think that accepting is the way forward.

    That defence (I've had it) is not worth the paper it is written on, and they know it!

    They really aren't above the law, thats why they almost never turn up in court to verify thier carp.

    Hi there its totaly up to you if you think the offer is fair then take it
    but personaly i would not ,and yes i would tell them if you dont they will take it as you agree if you do nothing ,see my previous thread regarding a letter i sent you can reword it to suit

    Well Barclays are a fine lot, I sent a SAR to them 17 April nothing within the 40 days!! Being a polite guy I contacted them- "Are you sure you sent it? We haven't received it!" new request done over the phone - will be with you in 40 days- 17th May.

    Contacted them every day since. Thurs 8th June got put in touch with customer complince manager statements will be with you within 7 days. True to her word statements arrived this Thurs, Friday so did 4 other copies of the very same ones!!

    Sent them a request for £995 and £255 sent recorded delivery!

    Will await there responce!!!!!!:j :j

    hi,
    i have been following martins advice with regards to my claim with barclays which amounts to £3100 without interest,i sent the letter asking for a refund,i then had the normal response stateing it would take 8 weeks to look into it,i then kept to my time scale and sent the next letter threatening court action!!
    that was 16 days ago,i have not received a response from them:confused:
    is the normal?
    what should i do know,i thought they may have replyed with an offer?
    i have read martins article and he suggests court or fos
    i to only have visa electron so may not be able to go the court route:confused:
    would love some advice...

    My court date is in October, does anyone think its worth me calling this litigation number at this relatively early stage to try and get a settlement?
    Started this process last October so its been a long haul!!
  • HEY Barclays wrote to me on Saturday offering me £1115, which I will take
    My total charges are £2000 but I just wanted enough to pay overdraft. And I did not want to take it to court.

    So thank every one for help and keep trying!
