    :think: Hi guys, just after some advise really on 2 points. I have just recently got my statements and sent the second letter off a few days ago. Now barclays bank keep phoning me up, and i have been putting it off cos i am nervous. Any idea on what they are about to say next? i know i read somewhere to use letters only. The other thing is what is the maximum amount for the small claims court? they owe me £3200 which is without interest as i have not included it. cheers :D

    My son has sent the initial letter complete with £10 to Barclays - no reply. Sent another letter and made phone call but still no response.
    What is his next step and how does he go about it?
  • Hi there, I rang Barclays regarding my request for my bank statements and they sent them out free of charge. From looking at other peoples replys I think this is the best thing to do as you dont have to pay for them. Try tinging them on 0800 282390. Best of luck as I'm still waiting for a reply to my request for my money after sending confirmation of how much I want back.

    After what seems like a LONG time waiting (with the help of a couple of chasing phonecalls to customer services), Barclays have finally written back to me with a response to my claim for just over £2000 worth of bank charges.

    In their letter, they are offering me £1,300 as a "goodwill" gesture. Should I hold out for the full amount - and more importantly - will I get it? If I went all the way, how much longer would this be likely to take?

    Also - the bank is continuing to charge me bank fees of £30 for going over my limit. If I accept the offer of £1,300, would this prevent me from claiming back future charges?

    I'd be keen to hear from anyone who has dealt with Barclays.

    I am with Barclays Bank and i have as most of us on here trying to reclaim my bank charges, Totaling to around £1700.

    I sent my first letter some months ago to which they did not reply, i gave them a specified time limit to get back to me and they did not so i wrote to them again explaining that i was UN happy with the fact that they had not replied to something this serious and that if they failed to reply within 7 days of this new letter i would be seeking further advice, anyway they they replied to this letter telling me that they have their own time scales for replying and me telling them when to reply by is not going to work.

    I have since lost my job and i have had some charges come from my account from a DD which i forgot to cancel, this DD has now stood me in at £50 O/D.

    I have at times been more overdrawn than this with my back and i have just paid it all off when i had got money to pay it but this time i have received a letter unlike i have ever received from them.

    it reads:

    TERMINATION NOTICE - Barclays account

    Issued in accordance with sections 76(1) and 98(1) of the consumer credit act 1974

    It is a term of your agreement with the bank that the full amount outstanding on your account is repayable on demand at any time. Pursuant to that term, the bank hereby terminates your agreement with effect from 27/06/2007 and makes demand for full and immediate repayment of the balance on the account (currently £49.05DR) with effect from that date. In the meantime no further drawing on the account will be permitted.

    If you do not settle the balance on your account the bank may transfer the responsibility for the recovery of the debt to one of its recovery units or agents with a view to taking action for recovery.

    Now I only made the claim because at the time things were a little tough for me and my family (g/f and 6 children) and then i lost my job, my former employer has failed to complete forms which the Job Center need to complete my claim (from over 2 months ago) and so i have been borrowing from friends and family and living on my G/f's money which between 8 of us is not a lot. I am really stuffed now because not only do i have no money and it doesn't look like I'm going to be getting any anytime soon, i am now being threatened by the bank.

    Does anyone know what to do regarding this closure of my account, i know its there way of getting at me for making the claim in the first place which by the way they have offered me a payment to settle this of £200 but they will still close my account.

    I really need some advice as i am going under here and fast.

    They could be ringing to make you an offer :D Don't be scared you're not in the wrong. The maximum amount for small claims is £5000 i'd be going for the interest aswell :rotfl:

    I really feel for you it must be very difficult did you not set up a parachute account as Martin suggests if you didn't then you must set up a basic bank account immediately sure I read somewhere that co-op and nationwide do them but I could be wrong on that someone else will be along soon to say for definate who.
    You are right they are doing it because of the claim and here is the thing try not to let it bother you keep going with your claim you will win eventually take up Martins advice of going to the FO if you feel you aren't getting anywhere a lot of banks are treating these claims as complaints and as such the FO says they have 8weeks to respond fully at least thats what they tell me.
    As far as your JSA is concerned go to CAB they shouldbe able to push things along quicker for you as two months isn't good enough I presume you are claiming tax credits for the kiddies?

    Also wanted to say dont accept their measly £200 however desperate you are far better to wait a while and get the full amount

    Thanks, you know its almost like they know whats going on in my head in a way beacuse at the moment im just doing anything i can to make sure my kids can eat, beacuse of the job loss and the lack of money i am behind on everything, phone bill, tv license the lot and i cant even afford to do the kids packed lunch for school, again its another problem in this spiral, the schools are refusing to give the kids free school dinners because at the time i was earning enough not to need free school dinners for the kids and now they refuse untill they can see evidence that i am on JSA but i cant because i am not in fact claiming anything so untill i am i cant provide them with what they want for the free school dinners.

    Did yours come form the Retail Banking Customer Relations in Leicester?

    What did you say to them when you called? I might givr them a call on monday!!

    Barclays have just acknowledged my MCOL claim and have until the 3rd July to defend it.
