Ok, well I think it was further back on this page which stated that once you had a court date you could ring them up. So I got mine on Monday and just called the number I had on the defence they filed. Honestly I am really nervous on the phone too, and I was shaking, and my voice was a bit shaky! Honestly though I shouldn't have worried, because they guys I spoke to were really friendly and basically apologised regarding the time its taken to get this far. (7 months for me)
I really would advise everyone who has a court date to ring them up and tell them you want to settle b4 court. I didn't even have to ask, all they asked was when was my court date and then they said they were going to settle full amount plus interest and fees.
Good luck everyone.:D0 -
Hi Hanmid
I really think you should ring up tomorrow!!!
Your court date is July! Mine was for september!! The guy told me they are settling A.S.A.P for court dates in June and July. I am 99 percent sure if you call tomorrow you will get an offer letter offering full amount by the end of the week/beg of next week.
They wanted to settle with me in July because they were so busy, but I persuaded them to settle with me this week.
Go for it!0 -
HI
Sorry to be really thick but I've been on here reading for about an hour and can't find a direct answer so here goes...
I received Barclay's defense today. Notice of TRansfer of Proceedings says the following on the front:
"... Please read the accompanying documents and note that the allocation Q should be returned to the Plymouth County Court"
There is no allocation form in with the letter.
On the next page is the stamped thing from Northampton Court. It says...
"IT IS ORDERED THAT:-
The filoing of an allocation Q be dispensed with in this case unless the District Judge at the court oif transfer orders otherwise.**
... PLease note that an allocation fee may be payable in thisn instancce. Please contact the court of transfer for further details"
Ok, so I have no allocation questionnaire and don't need one is this right? Should I contact the court anyway?
Then on the Defence copy that Barclays filled in, their defence states...
"The Particulars of Claim do not provide details of particulars of the account in question and / or the precise charges alleged to have been unlawful, or the date thereof"...
So did they not receive my spreadhseet of charges on my account? I sent these to Barclays originally. Should I now send them to the court and to their solicitor?
It's a really long defense and quite scary! Is this the usual stuff? There's like 11 points on extra pages too!
Any help gratefully recevied!!0 -
Hi there - I sent 2 letter , the first asking for statements for my wifes natwest account and the second asking barclays for my statements.
Natwest responded very quickly and the second letter has been sent claiming back around £2k in charges from them.
However, after giving barclays an extra week after the 40 days still no statements (this seems to be the norm after reading this thread!) - my dilemma is that I didn't send either letter to each bank as registered. What would you guys suggest I do contact the information commission regarding barclays not sending the statements or resstart the process by sending the 1st letter as registered(although people still appear to be getting no where fast even when doing this!!)
All suggestions - gratefully received.

I got copies of my partners statements from Barclays and have been through and added up the charges (£1200 ish with interest) Was just wondering where do I send the next letter? Should we bring it into her branch or to the address on the letter that came with the statements?
Thanks in advance for your help,
Starrboy:T0 -
After chasing Barclays for some weeks for statements I visited the branch and shook them up a bit. We have since received two sets of statements and a letter of apology! Sent the next letter off straight awat adking for fees to be reimbursed and today received a reply from Customer relations at Leicester. I knwo they are under pressure but this doesn't make sense:
"...May I take this opportunity to explain that whilst we will endeavour to respond to you within your timescale outlined in your letter, we cannot guarantee that we will do so.
Sometimes it does take longer to fully investigate a complaint. However we do aim to find a solution within four weeks.
If we are not able to do so we will always write to you explaining what is happening, a full update on our progress will be sent to you within eight weeks..."
It's a bit worrying when a bank cant count!
Elaine, i and my mum received this letter to and it seems to 'norm' and i posted asking for advice too, the nearest i can figure out from one answer i got was stick to my timetable, i am sending my follow up letters with court action 14 days from the date they say they received the letter. its entirely upto you what u want to do, u can give them the 14 days u originally said or give them upto the 4 weeks
good luck and keep me posted
kind regards

give them a ring ask why you havent received them, if they say they didnt get the letter they should be able to put the request thru over the phone, the number to ring is on the reclaim help post i think...
hope this helps

I sent my request letter in February!
1st offer should come in at about 50% of your claim
2nd offer will be about 75% of your claim
3rd offer comes about 2 weeks before your court hearing & I've still not got a date for mine yet
My first offer was 80%, minimum hassle, and its paid for my holiday, garden landscaping and the rest into an ISA. Money I thought I would never see again, so happy to settle for 80%Claimed back in 2007
Barclays Bank £2245
Barclaycard £ 504
Capital One £ 100

Thanks for that0
