    I just read the news article on BBC about MCOL, apparently there are about 300 claims going in a day for bank charges, so 3 wins for the bank in 3 months is a drop in the ocean. Find my other postings in this forum to see what's really going on and don't accept a low offer - it's a bluff!

    They won't settle till you get a court date!

    When you ring the number, give them your name and court claim number and ask who is dealing with your case and their direct dial number.

    REMEMBER they will not talk to you till you have a date for your hearing and they are not willing to settle early so keep adding up your interest ;)

    I'm claiming back varoius amounts from Barclays on behalf of my OH - got the first incredibly patronising letter back this morning offering £96 (I claimed £250 on this account which includes the £10 Data Protection fee).
    They disagreeing that the charges they made are unfair and dispute the legal argument I set out in my letter - they are also saying that I can contact the Financial Ombudsman if that does not meet up to my expectations and that if they don't hear from me within 8 weeks they will close the file.
    Can anyone tell me where I go from here please?
    I've got another 2 claims outstanding with them too!

    As you're not in Hull, then I can't see any advantage in waiting any longer.

    These days, your chances of getting all your charges back in response to a strongly worded letter are as slim as a size zero model. The first two letters are just to show that you have tried to settle the matter before you escalated it.

    But just don't go onto the MCOL website and play it by ear - do your homework first. Remember the 7 P's = Perfect Prior Planning Prevents P*ss Poor Performance.

    And when you do need any help and advice - you now know where to find it.

    Finally had a letter from Barclays today - refusing my claim in total. Guess that's the decision made for me and I have to start the court procedure....

  • Hi, can anybody help me on this.

    I have just recieved my bank charges letter from Lloyds TSB yesterday, it was worded very pleasantly which i was very suprised about. i have added up all the overdraft charges and unpaid d/d and s/o and unpaid cheques over the past 6 years but can i also claim for overdraft interest?? Some of the amounts i have been charged previously are as high as the overdraft excess charges themselves! i havent been the best at managing my account to be fair for the past few years but im not sure if i can claim these or not. Would this affect my ability to claim if i try for interest?

    just to let you know my charges since sept 2001 have totalled £4500! is it worth pursueing any additional interest or is this amount high enough, i believe the small claims court limit is £5000 is this correct.

    Any help guys would be greatly appreciated.

    Hi there no o/d interest cannot be added, you can claim up to maximum £5000 in small claims, you can add the interest up to this amount to claim via small claims otherwise you wouldn't be able to use the small claims court if your adding interest and it totals over the £5000,

    hi, in your MCOL claim you usually put down the amount of interest that you are claiming,can you add extra interest from the day you first wrote,reclaiming your charges,? if you can how do you go about getting it and how do you work out how much extra interest you have? Thank you.

    Just a slight correction here, the claim is £4,500 and is therefore under the £5,000 limit for Small Claims court as you ignore any interest that you might claim when you file at court or MCOL.

    and Kez is right, you can't claim back o/draft interest
  • I have just accepted barclays offer of £600 (was claiming £800)!

    Can anyone tell me how long it usually takes barclays to credit your account with this gogw??????

    I am currently trying to claim back nearly £2000 of bank charges from Barclays. I have been through the process and have just learned that Barclays are defending my claim in court. They have mad me an offer of £1200, but I am reluctant to take it as I have two other accounts with them and would like to claim charges from these aswell. If I cave in to them now will it make things more difficult for the next two claims.
    From reading the forums it would appear that Barclays are making life as difficult as possible for anyone claiming against them, I can't say I blame them, but are they defending every claim and are people winning their etire claim amount?
