I sent a letter to Barclays a couple of weeks ago requesting they pay me £2450. This is without any interest.

Im a bit concerned as everyone appears to be going to the courts!

What will be the next stages as Im a bit confused about the whole process?

I dont want to settle for any less than what im owed but what are the chances of this going all the way to court and what do I do next?

If you don't want to settle for anything less than 100% of your claim it is 99% likely to go to the court stages and that takes ages....

Hi I was wondering if anyone could help me,
Sorry if its been said before but there’s a lot of pages to read thru would be much easier this way..

    Anyway

I sent my 1st letter to Barclays bank on 18/04/07 and got the generic “we will contact you in 4 – 8weeks”bla bla bla

So then I sent my second letter on 1/05/07, because I don’t think the generic letter was a full response.

I did not hear anything back after 14days so I sent a 3rd letter on 15/01/07 it was pretty much like the second letter but I added the “Without prejudice” bit asking for a lower amount, hoping it would speed up the process as Id rather not take it to court.

I received a letter yesterday 23/05/07 from Barclays basically saying they are sorry but because theres so busy with this bank charges debate I have to wait till14/06/07

This is where I am stuck the 14day time limit on my 3rd letter expires on 28/05/07
Do I wait till 14/06/07 for a reply or shall I just start my court proceedings on the 29/05/07?

I was also told that I should just take all my correspondence with Barclays and lodge a complaint the financial-ombudsman.

Gah!? Please help if you can any advice id be grateful for thank you

Thanks esmerellda it's reasuring that I probably won't have to go to court, I hope you're right but if I have to I will :o

Well Barclays have filed a defence (not that I understand much of what they have put) and it has now been passed to my local county court. I did not receive an AQ is this normal? Have not had a court date yet. Has anyone recently been to court with barclays and won?

Not receiving an AQ is normal in some courts that are being snowed under with bank charge reclaims. You will still have to pay the allocation fee though. You should have received (or will receive) either an AQ or a letter telling you it has been dispensed with, along with a court date.

  • Hi all,

Have just received an offer from Barclays for £2000. My claim was for £2600. I have always thought that I would reject any offer but was wondering what the views of the forum were. It's a little more tempting now it's in black and white!

This offer is in response to the second letter, which surprised me because Barclays usually seem to like to tough it out a bit longer. The second letter was sent after the infamous court case a few days ago so it just goes to show even Barclays know that the ruluing in this case is meaningless.

Would be grateful for your thoughts,

    Chris

Thanks for that information I am in the same positon with Barclays having filed their defence late on the 21 May, apparantly because their date was up on the 19th which was a Saturday they are given extra time! I have waited with bated breath for this to arrive in the post nothing so far. Is there a time structure for them to get this to me?

Technically they don't have to send it to you, they only have to send it to the court. It is an accepted courtesy that they do send you a copy though, either way the court will send a copy to you, but that could be several days after it is received.
