Please can someone help me as I have now got a letter and I don't know if it is good news or bad!!
Having taken my AQ to the court at the end of March (!!) I have today got the following:
Notice of Allocation to the Small Claims Track (preliminary hearing):
"before the claim is listed for hearing the judge has ordered that a preliminary hearing should take place to consider whether the claim can be disposed of because the defendant has no real prspect of success at a final hearing"
I think I am ok with this statement.
The other one is
General Form of Judgment or Order
"at this hearing the court will consider either
a) to stay the claim pending the decision in a test case involving the defendant or
b) to give directions for this claim to be heard as a test case, and if necessary to reallocate the claim to the multi track for that purpose"
It is the words "test case" that are worrying me - my claim is for about £4000 - am I going to be used as an example??
No request for court bundles, other information has been issued - just these letters.

I'm obviously very late getting into this however, please could someone clarify an answer to this specific question:
When you receive your list of Barclays statements, EXACTLY which charges can you claim? I've already seen a 'GENERIC' list, but specifically to Barclays, can you charge "o/d protection 400@£0.80/100 = £3.20"?..... and also "Account Fee 1 @ £6.00"?

Sorry if its been said before but there’s a lot of pages to read thru would be much easier this way..
Anyway
I sent my 1st letter to Barclays bank on 18/04/07 and got the generic “we will contact you in 4 – 8weeks”bla bla bla
So then I sent my second letter on 1/05/07, because I don’t think the generic letter was a full response.
I did not hear anything back after 14days so I sent a 3rd letter on 15/01/07 it was pretty much like the second letter but I added the “Without prejudice” bit asking for a lower amount, hoping it would speed up the process as Id rather not take it to court.
I received a letter yesterday 23/05/07 from Barclays basically saying they are sorry but because theres so busy with this bank charges debate I have to wait till14/06/07
This is where I am stuck the 14day time limit on my 3rd letter expires on 28/05/07
Do I wait till 14/06/07 for a reply or shall I just start my court proceedings on the 29/05/07?
I was also told that I should just take all my correspondence with Barclays and lodge a complaint the financial-ombudsman.

Hi, I am hitting a brick wall with Barclays. I sent a letter on the 8th April requesting statements, this was sent to the business banking address for my husbands account (I have his permission to sign on his behalf). After waiting for a reply and not getting one I have been ringing them without joy. Finally spoke to a customer advisor monday who said I cannot speak for my husband. I explained that yes I can all the paperwork has been done (ages ago) and I have always administered his business paperwork - in fact the area manager has dealt with me. I pointed out this is the reason we are about to close the account after 30 odd years as we are sick of this attitude from Barclays. The woman was adament she couldn't check anything for me but said she could order the statements and we would have to wait another 40 days. Oh and the reason I need all the statements is that they have been really bad at sending them out and there are so many gaps. Should I make an atempt to travel to the branch and chase them up (its out of the area)? Or is there a telephone number that I could use rather than the general barclays helpline?
Any advice would be gratefully accepted.0 -
Hi all
I sent my letter off to the Data Protection Centre well over a month ago and havent heard from Barclays first or last - should I have at least received something by now? I included a cheque, all though I haven't checked to see if it's been cashed but Im starting to feel like it may been 'lost in the post'?
Is it possible they may have employed this tactic? Should I have sent it recorded? What should I do now? Where/who can I call to chase the letter?

I sent my letter requesting statement copies and fee off a month ago and havent received a reply yet. Mine went to my bank branch by registered post so I know they did received it. Their 40 days to send me my statement copies runs out on 8th June 2007.
The knock on effect has been noticed though, they bounced a cheque that took me £2.80 over my overdraft limit, something they have never done before in 20 years of banking with them, before they would let them go but charged me the £30.00 for exceeding my overdraft. This time I got charged £35.00 for the unpresented cheque plus the £30.00 charge - oh well more money to claim back!!
I have opened up a new account with a different bank. I have decided that I will be switching all my accounts to the new bank (childrens too) as I've decided that loyalty doesn't get you anything nowadays.
