  • if you win your case you choose how they pay it to you, if you accept an offer then they'll probably offset it against your account
  • Hi I have just had an offer from my bank Barclays' of just over half what they owe me. It is quite typical. they disagree with my claim but in good faith they are willing to offer 55% of the total. should i accept this??

Only you can answer. Is this acceptable or do you wish to pursue the whole amount?
  • they owe me just short of 2K. so i suppose i would like at least 85% of it back.. I have a letter from them with a letter of acceptance, how do i proceed now, do i return it with a letter of my own rejecting their offer or with one of the pre-compiled letters threatening court action?.
  • I would go for the full amount, even if it means taking them to court, remember if it does go to court you can claim an extra 8% interest and your court costs back. I think alot of banks are making silly offers with the hope that people are desperate for the money for Christmas and that people will cave in and accept.

My OH was offered £1945 after asking for £2259 approx, he rejected it and lodged his claim at the local county court, they have until tomorrow to defend or pay up, otherwise he has won by default. Hmmmm, wonder if that means they have a county court judgement against them??
If only they had paid up what he asked for, with the interest and court costs its bumped up his claim to £2969, oh well the banks will have to learn the hard way!!!

  • thanks for that.. i must add that i was surprised how quickly they have responded.
I recieved my 6 years of statements within 8 days. And the offer was recieved today only 10 days after i sent the request for my money back..
I agree they are offering silly amounts because of hopeful settlements and because of the time of year.

lets all keep up the good fight.....:money:  :T
  • Hi i posted a thread earlier today just want to elaborate.
recieved a letter from barclays after i sent a request for repayment of nearly 2K 10 days ago.
They made me an offer of just half of that, saying that they were aware of the points that i made in my correspondence but didn't share my view ( surprise surprise..) however they were prepared to settle my claim at 55% of the request. If im not satisfied they ask me to refer it to the banking ombudsman ( not likely... stalling tactics) My reply was settle in 7 days or I WILL take court action...Can't wait for the reply... Merry christmas everybody....

I think the banks think we're stupid. We're not, we were just downtrodden.

    NOW we're fighting back
