  • Between now and March you have to make sure you have all the correct details and be ready to go to court.

    Don't consider that it is the bank backing down but they may make you an offer before the court date and it will then be up to you if you accept their offer or not.

    I am at the point where I have sent off the request to Barclays to refund £600ish (no interest included in this). They have offered me a part payment, which I have refused. I sent the letter requesting a full refund within 7 days or go to court etc etc. That was about 3weeks ago. Since starting this whole process I have had 2 more charges of £30. I now want to claim these extra 2 charges and the interest on top for all the charges (it did say in the court letter that I would be claiming interest if we went to court, although it didn't specify what the interest amount was).

    Just after a bit of advice really. Should I write another letter to Barclays saying I am now claiming for these other 2 charges aswell and the interest for the entire amount, or should I just add it to the Court application? Also, with Martins interest calculator (silly Q time!) Do you calculate the interest on each individual charge?

    Stick to your schedule & add the charges to the court claim and any other paperwork from now on. Yes, use the calculator for each charge individually, the interest will be different for each one because of the dates.
  • Good luck - I asked for my statements ( 2 accounts) earlier this week and am looking forward to totting them up, could we compare notes as we are doing it at approx same time - will be interesting.

    I have rec'd a letter from Barclays today, saying "We are sorry you have had to contact us about the level of service you have rec'd from Barclays. We are looking into your concerns and will let you have an update or answer asap but no later than 9th jan 07"

  • I sent a letter requesting statements on 27th November. When should I recieve them by? Does the 40 days include weekends or is it just weekdays? I know they have had the letter as they have written acknowledging this and have returned my cheque.
    We finally did it! Debt free 28/6/10 :T :beer: :T :beer:

    Baggie bird: 40 days is 40 days, you don't have to worry about 'working days' or anything like that. In my case after they had returned the fee it was about a week... although I am about to file a claim for their refusal to send my barclaycard and monument documents.

    Hang in there. I know it's a pain when they drag it out, but they are, for once, within their rights.
  • Baggiebird1nil, Barclays sent my returned cheque in the same envelope as the statements. So if your stats don't come in the next week - i would contact them.

    I may have been lucky in that respect!

    but basically I spoke to barclays (about my credit card) today after getting the run around and found out the reason my recent payments bounced is because they cancelled my direct debit without my knowledge.
    As well as making it hard to get my statments (trying to charge me £3 per statement untill I told them this was illegal) they eventually decided to send me as far back as feburary for free, I dont know why they didnt offer more, but I guess its a start

    I was told I couldn't even arrange a payment plan unless i missed a payment, even though I owed them money (guess who's not paying on the 15th now)

    Are barclays always this difficult?

    I am also pretty sure that since the unlawful charges in the last 3months amount to around £150, - the last few years will more than likely add up to more than my credit limit (its only a £250 or a £400 card) What happens in this situation? Will they offer to just set my card back to £0 or will they pay me the ammount in full?

    Barclaycard ARE this difficult!

    Barclaycard have been telling people for a while now that they aren't entitled to all their statements, they recently got a ticking off from the information commissioner and are better now (although I'm still waiting for mine!).

    I can't answer your other question, I don't know if others here can, if not go to https://www.consumeractiongroup.co.uk and register there, they have a lot of 'general' knowledge on how to deal with banks.
