  • Hmmmm, I've worked out the interest charges for each payment using the calculator - not sure which to submit as my first letter (with or without charges) £2270 are the actual charges, interest works out at £247.27, obviously I'd be more than happy with the charges alone back but as this website suggests, the interest will either make them keener to settle out of court without interest or more reluctant to pay out... Hmmmm

    Tomorrow I'll photocopy my statements (I've marked all the charges) and send them to the bank with letter number 2.
    I'll keep you all informed of the progress.
    What are my chances of getting ALL my money back my Christmas? Lol

    you cant request interest back til you get to the MCOL stage

    money back for christmas? no chance! - ive been doin this since July - still waiting!

    they'll just ignore the part where you put the interest in anyways! so i really wouldnt bother, stick to the guidelines and leave them out til you make your claim with MCOL
  • Has anyone taken a Bank to Court over their charges.

    They offered my half and refused to pay the full amount so I issued a Small Courts Claim and now they've entered a defence disputing the whole amount...

    Has anyone else had this happen, if so how far did it get? As I am now in the process of filling out my Court Questionnaire.

    Lots of people have reached this stage. It's likely you will get a full offer soon after you send the allocation questionnaire back.

    Cheers, sent off the bundle today sans interest claim, decided it was wiser leaving it off until the final stages. Here goes the lengthy battle...!

    Thanks for that, I really hope so, they've made me so angry I'm even more determined now, and I bet they hoped that entering in a defence would have the opposite effect!

    Hi there all! I am luckier than most because I have ALWAYS moaned at Barclays about bank charges and got them back without fail. However, they have been particularly stick with a small business account I have linked to my personal accounts. I haven't used it for years but they charge £12 a quarter.

    I made a big hoo-ha about it about 6 months ago and got it all wiped off but they said then that I'd either have to close the account or the computer would carry on charging (which it has) ... so it has a £12 unauthorised overdraft right now.

    I told them they could do what they liked but I wasn't closing it, and I wasn't going to pay disproportionate charges on it. It doesn't cost them anything to keep the account open, does it?

    Some of you may wonder why I keep the account open .... well it gives privileges on my personal account (for example the size of transfers I can make on internet banking is far more businesslike). But I already pay £90 a year fee for a linked Premier card that I barely use with them for the same kind of reasons. I draw the line at that.

    My question is: Can I quote the Unfair Terms in Consumer Contracts Regulations in arguments against their £12 a quarter, or is the fact that this is a business account a barrier to the same protections as now apply to simple personal accounts?
