  • the thing is that i'm getting married in march and could do with the extra cash and thought i would give it a go so sent the first letter and said that they owed me £3,000 after nine days i got a letter back saying that it was none of there fault but as a good will gesture they would give me £1000 so i sent the second letter i did not excpet the offer and would like the £3000 and gave the 7 days to reply now they have sent me a letter offering me £1300 what sould i do know if i want to keep going to get all of my moey back do i start going to the court or do i send them another letter any one had this before and knows what to do ?????????????
  • You can reply saying you will accept the amount as a partial payment but that you will be taking them to court for the rest. Its up to you.

    Just confused as to what court name I insert at the end of the following passage:
    This is based on the Unfair Terms in Consumer Contracts Regulations, as I believe these default charges are unfair and not proportionate to your costs, and therefore the [INSERT NAME OF COURT] court will rule in my favour.

    Is it the small claims court, or county court or something else I'm missing? Sorry if I'm being a bit dense...

  • Hi everyone.
    I've been using this site for years but only just signed up for the forums..go easy on me!
    I'm starting an online diary here...so you can monitor my progress with the reclaiming of bank charges.
    19th Nov 2006..sent letter to Barclays requesting 6 years of statements, £10 cheque enclosed.
    24th Nov 2006..received 6 years statements..and my £10 cheque returned saying that there was no charge for the service.
    Today, 10th Dec 2006..just managed to sit and trawl through my statements for 2 accounts..only took and hour to find all the charges..just look for "@".
    Spent another 2 hours adding up the charges, working out the interest using the calculator on this site...and I feel guilty that I allowed my account to get so bad! (£4,445.07 charges inc. interest @ 8%)
    Anyway, I've got nothing to lose have I?
    I've already started the ball rolling with Natwest by opening new accounts there, just in case Barclays decide to close my accounts suddenly.
    Tomorrow I'll photocopy my statements (I've marked all the charges) and send them to the bank with letter number 2.
    I'll keep you all informed of the progress.
    What are my chances of getting ALL my money back my Christmas? Lol

    I handed my claim against Barclays into Northampton County court on fri 8th Dec for £3000 inc. interest. They made an offer of £1000. Temping just before xmas but i want my money back, and i am going to get it back. So just sitting around now waiting for Postman Pat or the phone to ring. (my birthday monday something would be nice)

    Has anyone ever known Barclays to go all the way to court?
    This is my first post by the way. This site is fantastic, could not have done this without the help of everyone.

    I'm no expert in things really but i do have 36 years of experience in life, and some of those years fighting off bailiffs.

  • Just sat down for last 2 hours going through 6 years worth of statements and entering data into Excel, I've highlighted the charges on the statements and separated the relevant pages, I'll send a copy of the excel sheet and the statements tomorrow with the initial letter (charges were £2270 from Feb 01, had a few throughout 2000 but they go outside of the 6 year cut off so I've only included fees from 10/Dec/00 (first charge was Feb 2001 after that date))

    dont let them charge you £3 per statment, I got 6 years worth of statments off barclays for £5 and they never even took the money anyway.
